  1. Don't be so fatalistic Stubby, With that attitude we might as well scrap TPOs and CAs (think of the money that could be saved) and make it a free for all. My argument is to push for a change in legislation, any money from fines should be kept local and used towards replacing/improving the amenity that has been lost. I can't remember where or who was behind it, but one of the American states used to have a scheme(still might) where if the home owner wanted to remove a tree from the front of the property, they paid into a fund which was ring fenced for new highways planting. Currently the system doesn't appear to be working, so maybe it's time to change things? I'll get off me horse now.
  2. Should we really be so focused on what is and isn't 'native' or, in preparation for climate change, present and expected future pathogenic threats be looking to increase species diversity wherever we can?
  3. But if there is no punishment for contraventions, the whole system becomes flawed and becomes pointless. One case that I know about, where a tree was felled after an application to fell was refused and a contractor was caught in the act, wasn't prosecuted even after the TO threatened to resign. It doesn't encourage anyone to abide by the legislation and just encourages all the fly by nights that we all complain about.
  4. Problem is that young trees often fall into the C category on development sites, so don't enjoy much protection anyway. If the replanting plans were better and not full of Sorbus and Prunus that would be a start.
  5. It would be interesting to find out how many LAs have actually taken a contravention to court in the last few years. I know that my local authority hasn't in at least the last five, despite have bomb proof cases with enough evidence to secure a successful conclusion.

  7. Don't hold your breath. While the LA has to take all the risk in prosecuting TPO contraventions and then all the resulting fines disappear into the central Government pot, nothing will change. Where's the incentive?

  9. Can I be outraged at the incorrect use of the term 'pollard'? Or would that just be me being a pedant?
  10. After a quick search, I think that these aren't actually morphine but Fentanyl, which is another opiate that is apparently a fair bit stronger.
  11. Sounds like a reasonable level of response to the immediate threat of severe harm or death. As long as you don't reverse backwards and forwards over him it's all good.
  12. It might help people's understanding if the legal context is considered a bit more. You are not felling with the councils blessing, in reality you/someone has told them of the intent to fell (remove) the tree. The authority have not opposed the intention to remove by protecting it with a TPO. Once six weeks have elapsed since notifying and before two years pass and in the absence of any TPO you can legally do anything to the tree as long as work doesn't exceed what was notified. So paint it pink and cut it in half if that's your thing. If you notified to remove it, it doesn't matter as long as the work is done within the time limits and less than that notified.

  16. After posting, I thought that you were a lot more experienced and my post may have been condescending. I'd rather climb a dead elm ( even 10 yr dead) than a newly dead ash, they just go so bad so quick.
  17. Can't help on the borer, but ash generally isn't very durable once dead and gets colonised by fungi that starts to to reduce its integrity. It's nothing at all like dead oak or elm and hence the concerns with owners not removing Chalara infected ash promptly.
