  7. Rich Not this year matey family commitments Joe via affiliation & recognition , in the same way as most things I suppose a brand often sells itsself once enough people talk about it ..... if uptake isnt in sufficent quantity, then it will take longer to gain status for the Guild. often there is wisdom in the line "you've got to be in it, to win it" I'm sure that the discussions I & the others have had with tree workers & surrounding industrys are a but small indicator of the strengh of feeling, The grand total effect can often often be greater than the individual parts that have made it. We are aware that for sometime, Years if im honest that a need among the industry requiring representation & recognition & many are chomping at the bit... I think you will agree that anyone who believes that they are professional would be more than happy to stand on the roof & shout it, if they only felt it would do any good.
  8. Josh The idea is to be from grass roots up private personal members (who may or may not work but may wish to support the scheme) including students The individual criteria is based on recognition of a set skill criteria.( including insurances as may be applicable ) whether that is a self employed subbie climber or groundie. in that way a certificate can be a route to advertise your professional approach to other like minded potential employers. who can employ sub contract services with confidence to match or enhance their own company skill base. though this is not encouraged as a long term ie permanent subbies rather more to meet shortages in a skills requirement. Then the company which can be from, the self employed men & a van to the medium or larger tree company. We know that the size of a company does not directly correlate into the quality of the services it may provide. in that way we do not wish to exclude anyone who is professional in their approach & committed to safe professional tree works. We all have to start somewhere, we simply wish to encourage a development toward a criteria many aspire too, whilst still giving due recognition for the efforts made thus far, however we are aware that many clients do not require a bells & whisltes approach & that too is fine a member will not be forced t oseek full accredition if their business profile doesnt need it. But they must remain fit to trade as per the recognised criteria Far too many very good tree practioneers do not have a route to express their views in places & events that directly affect the industry. We hope to dispel that practice for a more rounded over view from within the industry. Throughout all sectors of industry it is often the case that the voice of the smaller entrepreneur / business are not as well heard by those who may wish to take heed of a wider consensus. larger blue chip companies often speak loudest due to their commercial position. Yet the comments of the less well represented maybe equally as valid.

  19. the Europeans thought that, well Germany anyway (it was illegal for a German citizen to work form rope & harness, that’s why the brits did it for them & I am led to believe that that decision has now been reversed So what do we do, try & reinvent the wheel: Bloody typical I would much rather trust the life line that I have inspected, the knots which I have tied, placed around a safe anchor point that I have chose, clipped to a harness that I know to be sound with attachments that I secure with equipment I have checked. Over the capabilities of a machine I have little knowledge of (Load bearing Wind stability), which is inspected and maintained by A person I do not know & therefore cant trust my life on , Who may or may not have carried out a routine schedule maintenance program to a specification that I have no knowledge of ......... What man Can Make man will break & I for one dont want to be a statistic. SO use a Mewp Fine I have , However horse for courses & donkeys walk on beaches So there
  20. In short Yes Neutral Citation Number: [2009] EWHC 220 (Admin) Case No: CO/5568/2008 IN THE HIGH COURT OF JUSTICE QUEEN'S BENCH DIVISION ADMINISTRATIVE COURT Royal Courts of Justice Strand, London, WC2A 2LL Date: 13/02/2009 Before: MR JUSTICE CRANSTON - - - - - - - - - - - - - - - - - - - - - Between: Palm Developments Limited Claimant - and - The Secretary of State for Communities and Local Government Medway Council Defendant 42. As for the temporal reach of woodland orders, I see nothing illogical in tree preservation orders applying to future trees. The tree preservation order for the one tree, or for a group of trees, may be intended to apply to specific trees only, but a woodland order would seem designed to protect the undifferentiated mass of trees in the specified area. The order would not achieve its purpose if it applied only to the trees existing at the date it was made. Since those trees would die it would be necessary if the woodland were to be protected to make new orders, on an uncertain but periodic basis, to continue to protect the trees in the area. That cannot be a sensible construction of the legislation. As the Blue Book suggests, because the purpose of a woodland tree preservation order is to safeguard the woodland as a whole, which depends on regeneration or new planting, it must extend to trees which grow or are planted after the order is made. Even if I had any doubts that this was the correct interpretation of the 1990 Act, I would find it difficult to gainsay the remarks of Hutchinson LJ to that effect in Evans v Waverley DC, albeit that the conclusion may simply have been assumed.
