  3. Paul, I was reading the thread http://arbtalk.co.uk/forum/general-chat/87995-5-day-notice.html a while back. It seemed to me that it could be the case that a dead tree with a TPO might not be considered as "valuable', or perhaps to put it another way "worthy of protection" as a living tree since a full TPO app would be required for a living tree but only a 5 day exemption if it were dead (notwithstanding there may be circumstances where a dead tree might present unacceptable levels of 'risk' or management burden, but surely it could also offer enhanced habitat and aesthetic / amenity worth also?) It struck me that it appeared to be "assumed" within the current construct of regulation that since the tree was dead it automatically receives less attention than if it were living. Appreciate your view on wether this is something that might be considered. Equally, if there's a well argued reason why dead = 5 day exemption, living = TPO app I'd appreciate an insight to that if you know of it. Another point that I have not been able to get a satisfactory answer (from nearby LA's) is the question of review, variation and revocation of existing TPOs. To summarise the responses I've received locally, it's pretty much a case of "we don't do that, insufficient resources." I can example where this has led to frustration, expense and antipathy from a land owner towards both the LA and the prospect of having TPO's applied in the future. Not sure if these would be the type of question / feedback that might be welcome but if you think they are, I'll get on and get some detail together and send it on to the address in the link.

Won't it be normal for the Tree survey and AIA to be compiled prior to the plans being drawn up (I know, reality check myself there!), then for them to be submitted with the planning application (and all the other supporting documents) which are available to view via the portal for public and LA consideration?

  6. Would it also be wise to consider the wider public when compiling? TO's might find the "back ground detail" repetitive, but they can always skim over that. Perhaps some level of generic explanation might preempt or avoid a disgruntled letter of objection from a concerned or obstructive neighbour? Would that be a valid consideration?
  7. A thought provoking topic. Whilst on the one hand, I can see how (if you take that stance) paying out (regardless of the amount) and getting nothing in return (if you take that stance) is a fairly bitter pill. If anyone can't see that, try adding £80 per week to your spending whilst expecting nothing extra in return. Conversely, it'll be tough on the injured party who has a drop in income. If it's a "valued, respected, hard working, innovative and loyal" team member perhaps it would be easier to bear because it might be seen as an investment in the future, but what about if that's not the case? What about the way the injury was incurred? Is rugby OK but drunken train surfing not so good? Seems to be no distinction. At what point does the individual take responsibility for their actions? I can't help but feel current society trends towards it always being someone else's fault / responsibility / liability. Just waffle I guess since them's the rules!
  8. 110/130 tipper or with a tipping trailer: Pro - better than a van if you are off road and good towing capacity. Con - dreadful turning circle. Why have 4x4 if you don't need off road. Transit tipper: Pro - plenty of formats and availability. Con - limited load capacity. 3-5k budget is going to seriously limit your options to a heavy miles / heavy use vehicle which may incur significant maintenance liabilities. Have you considered lease? It's not for me but a good option for some - new vehicle, looks the business, get the format that best suits you??

  13. Possibly, but not anti Scotland. Can't be sure because I didn't pay enough attention, but I think the article was written by a Scot - not at all sure about that though and happy if corrected.
  14. Yes mate, domestic / day to day work generally doesn't have to be through CIS. If it's a site clearance for development it most likely will be CIS. I just registered as a "contractor" so I could bid on a site. It was not too troublesome getting registered, but trying to contact HMRC with queries etc is hellish on the phone / website. If the main contractor deducts CIS from your invoice and you have "self employed" people giving you invoices for their contributions to your output, then you ought to deduct CIS from them too. You need to be registered as a "contractor" in order to deduct from your subbies and they all need to be registered as "sub contractors" so that you can make your deductions. Plus you also need to be registered as a sub contractor so that the main contractor can make deductions from you. It's an outrage that (a) it's so bloody admin heavy and (b) it's close to impossible to talk to CIS help desk by phone. Talk about stifling beaurocracy! I've just been through all this in the last month and it's made me wonder if it's worth the effort. If you're not on a site and CIS doesn't apply, it's still worth asking your subbies to include their UTR on their invoice. It shows due diligence if HMRC question your "expenses" for hired in labour. Apparently, if you show expenses for hired in labour and HMRC find that they have not declared their income properly on their self assessment, HMRC will deduct their income tax (for that element) from you! That's just my limited experience, doubtless there will be some better informed (or highly opinionated) views to follow....
  15. I think CIS would only apply if you are on a construction site. Have you registered as a CIS contractor? I've had a guts full of the helpline (that isn't!). It's near impossible to get someone to answer the bloody phone!

  18. Hey Mark, just a small reality check on the Service pension issue. Granted, with public sector retrenchment over the previous few years, there has been a certain uplift in ex Service personnel entering the sector - no doubt, some good, some not so good but no difference in the college or work based "new blood" on a pro-rata basis I'd suggest. I'd also suggest that the number entering the sector with a Service pension is really quite low since, give or take, it needs 20 years service to achieve a pension and those that qualify are more likely to be 40yo + before they qualify for a pension and they are not the sort of people that work for peanuts. I can't comment on the "granny's money" perspective, but (and only from my own perspective and reading some of the ridiculous pricing threads on here) I can say, that having 30 years Service before starting this game, it's not those with Service pensions that are driving prices down. I'd rather lay on the sofa and watch Homes under the Hammer than turn out for a mugs game that's been under priced! I'm totally on side with the "we're too cheap" line. I genuinely believe the industry is obsessed with under pricing and kicking itself in the nuts for the sake of getting the work. Baffles me!

Would it be safe to assume that: (a) if the whole dead tree is felled there may be a requirement to replace (according to conditions applied by the LA at the time of considering the 5 day exception.) or (b) if the tree were reduced to ameliorate the perceived risk of collapse rather than felled completely, then the requirement to replant may not apply since the original tree still exists?
  22. Wouldn't it be the case that the trees would have to be dangerous rather than just dead to qualify for a 5 day notice. They could be dead but not dangerous which would be a standard TPO app??
