  1. Good stuff! I've had the AR Drone for a couple of years but found the picture stability can be a bit poor. It's the way ahead!

I had a quick look at R v Caldwell, it would appear that that case, and the test for recklessness defined within, have been over ruled by: https://webstroke.co.uk/law/cases/r-v-g-2004 Surely it would potentially be considered reckless if a tree had fallen and caused injury / damage? Stuck between a rock and a hard place!! I thought of interest the second bullet on the exceptions from the RSPB site: The RSPB: Wild birds and the law: Exceptions Maybe a bit of an own goal by not getting the work done during the Winter. Leaves me wondering if it was a decision borne out of financial limitations or poor planning? I don't have a "stance" either for or against the NR actions here just for clarity but I am finding the debate / discussion interesting. I think it was an incomplete / potentially bias piece of TV news reporting though.
  3. I can't find anything that seems relevant in CRoW Act - a riveting read though - picked up some new info on occupiers' liability in relation to access land. Have I missed it tucked away in there somewhere? Left me wondering, if CRoW Act supersedes CaW Act (in this example - intentionally v recklessly, - or any other circumstance where one Act seems to cover a similar topic as a previous one) which Act takes precedence? Is it safe to assume that the later one has greater weight than any previous one or do they both remain relevant in their own right? I can't really see where any chance of a successful prosecution of NR could be anticipated in the example reported on C4 news. Surely it can neither be considered "intentional" if they did a survey before hand (and it came up negative for nesting birds), nor "reckless" if it was part of a planned operation. I'd say there has been more discussion / investigation of the subject within this short thread than appears to have been done in the C4 news production team. I bet the protestors are happy with the coverage though, regardless of the accuracy of the story, they made prime time TV and put negative PR on NR.

  7. It was a poor piece of TV news & a poor blog, maybe they failed to properly research it or maybe there's an 'agenda' being progressed? Quote from a quote in the blog: "It’s an offence to disturb or destroy an active bird’s nest,” said Mark Thomas, senior investigations officer with the RSPB." Maybe Mark Thomas was mis quoted or maybe he genuinely doesn't know the legislation which clearly states "it is an offence to INTENTIONALLY blah, blah, blah....

  9. I don't have as much demand for the grinder as I thought I would have had. It's a handy addition and paid its way but in hindsight I might not have bothered. The mini loader was very close to being the panic buy at end of 14/15 tax year. It's still on the cards for this year. One thing I'd say which might be a point to consider, how will having another machine affect your transport arrangements? Depending on how you're set up, it could mean an extra trip to / from the job site because the machine is taking up the trailer space that might otherwise have been full of chip / log. If that happens, any time saved by using the machine could be lost to additional travel time. Just a thought, I'm not sure there is a "perfect" solution, every time I think of a reason to buy something, there seems to be equal and opposite reasons not to!

  13. Jesse, was it the LPA suggesting that costs would be incurred regardless of judgement? Wouldn't that be a presumption on the part of the LPA (presumption is one way of putting it, intimidation might be another since, surely, it would be for the court to deliver a judgement and allocate costs?)
  14. It's (one of) the power(s) of Arbtalk Gary! She's heard / seen me unexpectedly shout / laugh / swear in equal measure and the only explanation I need to give is "its Arbtalk!" And that seems to cover it! Spent many weekends in Amsterdam whilst working in Germany but this was the first time I'd taken a female companion with me. As a consequence, I saw parts of the city previously unknown to me (I'll even admit to taking a "hop-on" bus tour that ventured outside of my previous area of operations.) On that bus tour I was really surprised by the "greenness" of Amsterdam - I even tackled the tour guide on the lack of reference to (what I thought) was some really interesting amenity tree issues (apparent lack of management of some really interesting stock). Too much "Blah, blah, blah, Anne Frank, Rembrandt, windmill, canal." Not enough "avenue of Elm, veteran Plane, electric tram cable with tree in it, poor root area for urban tree etc, etc". Tour guide glazed over and wife dragged me into diamond polishing museum.... SO WISH I'd bought that book for you Jon! It even came with 3D goggles!   16. That'd be the key point (regardless of ownership) "if they are inclined to do so." If they are not so inclined, establishing ownership would be academic. Unless, having established ownership, you were to seek the owner's consent to replace at your own expense. Might all be hopeless if the neighbour isn't willing to engage. Neighbours - can't live with them, can't live with them!

  20. New but still not very front end user friendly - quite a few links that don't and a search function that doesn't! When it can be found though there's so much good stuff! Just been trawling the resources tab for the booklet you mention above Jules, could you give us an idea where abouts it is on the site, I couldn't seem to find it.
