unimog and the rules !! FACTS needed!

The confusion over red and white diesel does not apply to agricultural or not per se but is defined by hire and reward, ie if you were hauling timber for your own use or as part of an extraction job you can use red but if you were specifically hauling timber with a tractor for someone else it becomes hire and reward and you should drain your tank change filters and refill with white.

I think youll find that the actual description of a tractor is covered by the construction and use act, a three point linkage and pto, is a major requirment, and nowhere does it mention no loads, and the name unimog, means tractor, as I said before, there are NO grey areas, its all written down in black and white, its only when "tree sugeons" try to say that its forestry work or horticultural work that problems arise, in 10 years of running a mog, and being stopped several times, I've never had a problem because I printed out the rules, laminated them, along with rules for use of red diesel, and keep them in the vehicle. DVSA"VOSA" cannot make up there own rules, and when presented with a copy, they will back down, so will plod

 

So Mog with tipping chip box and no 3pt linkage is just a load carrier ! Will be rare to find one but they exist and yes I agree with everything you say I was more aiming towards the speed side of it in my post .

You don't need to go down the whole drain / flush / replace filters etc to then run on white.

 

Got dipped years ago when delivering manure around Newcastle and the machine the then VOSA used, could distinguish between how much red and white was / is in the tank.

 

And has no one mentioned if you need an O licence, don't you need your DCPC too etc??

Vosa are your only problem, the traffic police are not intreasted until there is a acident, I'm selling my unimog , been great but need a small loader tractor, I love my mog it will be missed, running it on white and having it on a hgv you might as well just get a big tractor with 50k box and avoid the hgv licence.

 

 

 

That was my view on the mog vs tractor thing too.

Almost normal for a modern tractor to have a 40/50km box nowadayys and better off road capabilities if needed.

 

So are most of these tractors not legal then twisted? Most have air brakes and all sorts of things now, but like u say not usually independent suspension on rear axle

 

 

I know the local agri contractor's had some bother with the polis a few years ago for red desiel etc as they had a bit of a clamp down.

1 bigish job a contractor was hauling muck about 10 miles from a shed to a field and dumping it in a heap.

As he had the contract to spread it it was ok to run on red, but if he was only hauling it it would need to be white.

A few of his tractors where stopped but he had it in writing from the head of traffic and managed to get a letter of apology of the local chief constable for the way his men were treated and attitude of trafffic officers

My take on this is two pronged, firstly is the fuel. Red for agri/forestry/horticulture which in my eyes is clear cut. Second up is the registration class, a mog or tractor running the same rules on fuel duty imho cant just switch fuel to circumnavigate registering as an HGV. Its one thing or another.
