I know a few people who run mogs on red and one has a old Bedford truck, it's a 5 tonner which has a crane arm, been replated as a crane so he runs on red no probs.

 

It does sound like you got of lightly, strange how they appeared out of the blue though

The fine was only £350 could have been a lot more... the trees were roadside and we don't have a chipbox on the mog. The owner does honestly as do i believe he has done no wrong.

 

I wasn't asking other owners to say yes I am using red when I shouldn't I am just curios who believes they are legal when they might not be.

The irony of it is that the two gents were looking for a farm when they saw us and decided to have a closer look but both of them didn't know the law on this vehicle.

 

Many years ago we were working near a hospital, two HSE guys suddenly appeared on site asking questions. They had been to the hospital to interview a worker who had been injured at work, saw us and just decided to check us out.

 

Fortunately they were happy with us.

Exactly.

If they the "professionals" in this field dont know the law, how do we have any chance?

Reading the link above leads me to believe that you should appeal. Roadside trees are clearly ok.

Hi tom.....I'm the guy who got dipped....we were working in a school bordering a public highway.....the guys from HMRC, didn't really know a lot about unimogs and need to speed to someone higher to get some info...my solicitor is looking at it and hope they say I have a good case.....£350 was pretty cheep.cheers jase for sharing this...
