  2. In the last place I worked we had a claim following a serious injury - not tree related but the points of law remain the same. Although the feature in question hadn't been inspected, a regime was in place and was well documented. In other words, the court accepted our defence and was satisfied with the notion that with the best will in the world no one can inspect everything all at once. Or to put it yet another way, the duty of care extends to taking all reasonable steps to ensure the safety of your visitors. Superhuman efforts are not required and the resources available are a material consideration.
  3. Trespass is a civil wrong (a tort) rather than an offence (except in defined criminal trespass). Remedy is damages based on actual loss.
  4. I do quite a bit of running, swimming, gym work and circuits. Doing the Ealing half marathon in September and the Tough Guy and Tough Mudder as well. If anyone in the London area wants a trainer, this is the guy I use and I thoroughly recommend him http://www.commando-training.com/

  6. Bring it on. If the govt wants to read my emails and texts then good luck to them. If we ever get to the state where we have a govt that would condemn people for holding particular viewpoints, then I don't think they'd bother with a piece of legislation to pry into people's lives. Or listen to what the courts had to say baout it.

  8. Valid point - however, one of my uni lecturers came with a catalytic hydrogenation process 9 or 10 years ago. Haven't heard much about it lately... On a slightly more serious note, whatever technology is theoretically available, it's highly unlikely to be cheaper than something that pours out of the ground. Yet.
  9. I've mainly been a believer in human induced climate change, though I have swung back and forth a few times. I'm certainly not a climate scientist, though I am scientifically trained and base my views on evidence, not favour. One thing we can be fairly sure of is that we will continue to use fossil fuels (a) unless and until something cheaper comes along, or (b) they run out. Note that as (b) gets closer, (a) gets more feasible. I would also be very surprised if the oil companies don't have a trick or two up their sleeves. Ten years ago the UK parliament heard (and accepted) evidence that oil was expected to last for a further 42 years. Presumably that figure has increased, but one day it will run out. Do you really think their strategy is to hang their hats up and go home when this happens?
  10. Don't forget that Shropshire has been at more than one latitude over the last few billion years - not all of those things happened 12 degrees south of the arctic circle!

  14. I find it strange that people find it hard to accept that an increase in atmospheric CO2 will raise global temperatures. CO2 is a greenhouse gas - this is scientific fact and is down to its absorption spectrum. Without it the world would be far less habitable at our UK latitude! There is a clear correlation between CO2 levels and average temperatures, but please make up your own mind which way the cause and effect relationship goes. But we know that CO2 is a greenhouse gas.   17. Could be nitrogen deficiency but given the yellowing is more towards the leaf tip I'd be more inclined to go with magnesium.

    Arb courses.

    I think Myerscough do the FdSc in Arb via distance learning now don't they? Not sure of any Scottish colleges doing any that way. But as was said above, why does it matter where the college is situated?
  22. I've been tempted to write into the Radio 4 programme 'Genius' - BBC - Radio 4 - Genius- About The Programme - for some time now with an idea to fix the CO2 problem. All we need is a series of solar powered satellites with big pipes to suck up the atmosphere that run fractional distillation plants to separate the air into its component gases. The CO2 is sent out into the universe, the rest is sent back to Earth. Genius, yeah?
  23. Sea level has risen by 7 inches in the last 100 years, and is predicted to rise by about a further 24 by 2100. That will be noticeable.
  24. Irrespective of where the responsibility ultimately lies (which is probably with the land owner anyway), the land owner has a duty of care to employees, visitors and in some circumstances trespassers. The land owner now has notice of the hazard, so denying liability would be very difficult at least, and probably impossible.
