    I'm so sorry to hear this, I've been thinking of him and you all day, about the answers he took the trouble to provide and knowledge he had. I truly wish that I'd met him cos he came across as such a decent bloke, one of the good guys! I'm sorry, I don't know what else to say.

    Getting well isn't always a linear progression, I know from personal experience, but stay strong mate and keep positive. He's under expert care which will deal with problems as they occur. Try to view things as setbacks on the road to recovery. Thoughts are with you, Goaty and your families.

  10. Should have lifted at the centre of gravity. Obviously putting the tine in his lug hole created an off-centre load and the torsional forces initiated overloading doh!

What I was thinking, saying that the neighbour IMO had responsibility to safeguard his trees was more along the lines of pruning to wind firm them after the loss of shelter, a reasonable approach by a prudent person? If your neighbours cattle get onto your land it's clear cut. An owner has a responsibility for something on his land not effecting others. Yew hedge comes to mind. If it escapes over the boundary and gets eaten, then it's the hedge owners fault, but if a horse leans over the fence to eat it, then because the hedge owner has kept it on his land it isn't his fault.
  21. I think this has been discussed before and someone more knowledgeable than me said there was nothing to prevent this situation. Would you be responsible if you removed a tree that sheltered your neighbours house, which then lost its roof in a gale? Maybe my view is too simplistic, but how far do you have to put yourself out to assist your neighbour and does the law expect you too? Is it reasonable that the neighbour, being aware of the change in circumstances, takes action to protect himself?
  22. Funny enough, I fail to remember the companies whose adverts irritate me. I know the adverts but not what they're selling.
  23. It beggars belief that these situations occur. I-tree is becoming more widely used in the U.K. To demonstrate the financial benefits of urban tree canopy cover, in pounds and pence for the bean counters. This, coupled with well publicised court decisions about the duty of care regarding LA tree management and they still look to cut the Arb budget! Idiots.

  25. We're on first name terms with the girls in planning don't worry. As there's no TPOS or CAs online, let alone planning agreements, and their computers seem to run on about 8mb of RAM (10 minutes to load their search page), we have plenty of time to chat and get to know one another
