Excellent post and hopefully it will make those new to the industry , setting up, to price work correctly so as not to face the realization at the end of there tax year that in real terms they have been working like busy fools all year for no reward and no money to replenish any worn out kit. My values are very much the same.

    Caught him!

    Caught him! now that caught my attention, off rail a bit now but i am of to court on the 28th this month , not me in trouble with the law but some one who has over the last 10 years tried to break into my yard lots of times. He has spent much of his life inside but has only recently started doing more serious stuff like jewelry shops and the like, hes up'd his game a bit, but hopefully now going to do some time, never been to court so i am going to enjoy the day, taking me flask and sarnes so should be a good day out :thumbup: scum .

On a fresh stack I normally do a test burn on my own stove first be for selling, thats seasoned cord, split and put in the stove straight away that night just to see how it burns, only a few bits to see how well it heats the water and cooks food in the oven, if its good to go it goes if its too good it gets put on my own stack and if its not ready it gets done next season. Just cut in to a stack of Horse Chestnut and was always led to believe it to be rubbish wood but this was 3 years old, fresh split and it sent my oven Richter scale off the clock, almost had the header tank boiling.

Andy you'v hit the nail, this country is going down the pan and the ever increasing hoops we have to jump through is why, I don't give two hoots who is qualified or insured I just do my very best to better my knowledge in the industry and cover my own back and the interests of my family , thats there house and my retirement, if you are not qualified, and some Arbs IMPLY they are or are and not insured , and some Arbs imply they are, you are leaving yourself and your family's inheritance to chance, Its just a great shame that there appears to be a large number of people in this industry who take that risk and wing it, cutting corners where ever they can and ill advising clients for profit . When the brown stuff hits the fan it can run down hill for years. Time scale can go on and on when there's a claim it can be a roller coasting landsliding bill for someone at the end.

I know what you are saying and agree, there are also a lot who advertise them selves as 'fully qualified' and yet only have NPTC units, hold your hands up if you are guilty? and there are also a lot who operate without insurances . Unfortunately its the customer who at the end of the day, or year depending on how the tree responds, who looses out in the end. I also know there are some who advertise 'fully qualified and insured' for your peace of mind and have neither.
  9. 10.9 As a general rule it is no defence for the defendent to claim ignorance of the existence of a TPO. Nevertheless, the LPA should ensure that a VALID TPO exists, that the tree was CLEARLY protected by it and that they HAVE carried out their statutory functions PROPERLY. In one case, the defendant escaped prosecution because his ignorance of a TPO was in fact due to the LPA's failure to place a copy of it for inspection as required by the Regulations. I think your time would be well spent to go and inspect all paper work relating to the order yourself, they should provide a private room for you to go through all the paper work which should provide your answers, your TO is unlikely to be so methodical, make notes of any errors or ask for copy's, this way when you do have your site visit with him (the Tree Officer) you will already have all the information to hand for clarification. Explain your intentions and get him to confirm in writing what ever is agreed or just the outcome of the meeting as discussed .

PROCEDURE WHEN THE TPO IS MADE. 3.21 Under regulation 3 of the 1999 Regulations, the LPA must, on making a TPO serve the owner and occupier of the land affected by the TPO: (1) A copy of the TPO, and, (2) A notice (regulation 3 notice) stating: (i) the LPA's reasons for making the TPO, (ii) that objections or other representations about any of the trees or woodlands specified in the TPO may be made to the LPA, (iii) the date , being at least 28 days after the date of the regulation 3 notice, by which any such objections or representations must be received by the LPA, and (iv) the effect of the section 201 direction if one has been included in the TPO.

You are correct, for a long time i only had NPTC Tickets, I knew how to use a chainsaw but lacked confidence when meeting clients , at the back of my mind i lacked confidence when talking to a customer , since gaining my first Q it instantly solved my confidence issue and made me hungry to learn more and continue my own PD .You never stop learning . The best investment i have ever made has been my own education.
  13. I am with you on this only I would say NPTC ALONE only qualifies you as a CUTTER OF WOOD , nothing more, it simply states or implies that you are trained to cut into wood, on the ground or at height. Its a great shame that this chainsaw level of competence seems to confuse so many people .

    I love the smell of dog poo in the morning , Smell's like VICKTORY over your competitors , when the fecal matter hits the spinning blades of the fan, or the mower or the blower or even better the strimmer you know you'v under priced the job and its time to get down and dirty , (WET WIPES) its normally those jobs which end up being the bread and butter work. When the going gets tough the tough get going .
  16. We all drink from the same water troff and we all poo in the same way, class, its just your own perseption of life, ME i'm my own king all though my wife would call me some thing else.

Its not up to the insurance company to make sure you are adequately qualified they are just happy to have your money, its up to YOU to MAKE SURE you have read and understood fully the conditions of your policy, (the small print/caveats that they WILL have in place to remove liability should they deem you have not complied with there conditions) This will include- was a Risk Assessment done, LOLA Dates for kit and they could even ask to inspect your equipment to make sure its fit for purpose,when was your last H&S INSPECTION ? When the POO, how ever small it may be, hits the fan, its surprising what a mess it can make. I hope no one takes offence and all other post have not offended me its good to hear the difference of opinions, this is also one reason why we have such wide differences in pricing of jobs , those members like myself who do comply fully with current legislation and are well qualified will always be more expensive than those who don't. One last thing, the more qualifications you have and memberships to recognized Associations the cheaper your insurance will be, and should you have to make a claim they will look into everything.
  18. Hi Jim, first of all i thought this was a ptake. The answer is no, you are not insured under your own insurance or that of the nursing home, pass the work on to a company who are insured and just ask them to leave the wood for you . HSE could prosecute you if they were informed of your activities . And i am sure the owners of the care home may also have something to say !!

  20. All of the above but Sidney, and i did it on a holiday visa, try active tree services , there are lots of opportunities if you are a good climber and a hard worker. Have fun i did.

Just re insured with you chaps and thanks very much, you offered the best comprehensive deal, and at a great price, I wonder how many Arb members do actually have insurances in place with an understanding that if you don't have qualifications you are unlikely to get cover!!!! this is also why there is such a great divide between quotations , you FREE SPIRITS out there are destroying the reputation of the industry.
  23. OK i see where you are coming from, simple way forward for you ring your LPA OR EMAIL, Give the address and ask if there are any tree constants relating to that address, if not just cut the thing down , end of ,hope you sleep well.

Mark i would say firstly employ someone to access the trees condition and ideally in accordance with BS 5837 recommendations then ask the question again, at the moment the original applicant is at fault and so is your LPA for acknowledging that the tree exists and not flagging up that an assessment carried out accordance with 5837 had not been carried out.
