Yes, good point. When Id'ing trees and getting any leaf samples, it is much better to try to get ones from mid range in the tree, at different positions, variations (sizes) of leaves "can" grow to absorb different amounts of light.

Went to the one at Sherwood forest, last went about 9 years ago. It's changed loads (apartments wise) for the better, and we had a great time. Fireworks were awesome on new years eve Sent from my Galaxy S2

The fungus in the first pic looks like what was Inonotus dryadeus (sp.), you may also have Fistulina hepatica in there too. Look them up in the fungi directory here and see what effects they have on the tree (oak). A far as assessment goes it's hard to say anything from those pics alone and if they are really worried you may want to get someone to inspect it in person just for "piece of mind".
