  2. Yes you only need the tacho when towing. However, if you tow and therefore use the tacho on just one day in a week, you are obliged to record your drivers hours for the whole of that week, even if you dont tow again. The logical conclusion to that is, unless you know for sure your not going to tow all week on monday morning, then you had better keep drivers hours records anyway. I get what you are saying re use the tacho when you are towing and just throw the discs away, and yes you probably would get away with it. However falsifying drivers hours records is a serious offence.
  3. Yes. If you get a digi tacho you need a digi drivers card as well, costs about £30 I think, and you will need to carry it even if you are using a analogue tacho that day. Overall, I would rather have an analogue, as the digi units make it very easy for VOSA to keep tabs on your every movement, and they dont really cut dont on paperwork. When I worked for a LA, a few years ago, they were just starting to get 3.5 tonners with tachos coming through on leasing plans. They also started making us keep proper drivers hours records for the 7.5 tonners.
  4. Far be it from me to suggest that you might set the tacho to break when you are having a friendly cup of tea with a client. Assuming you are driving a 3.5 tonne vehicle, and towing a 1.5 tonne trailer, you fall under EU regs. Therefore, you can drive for 4.5 hours, then you need a 45 minute break, then you can drive another 4.5 hours, so thats 08.00-12.30 driving/work, 12.30-13.15 break, 13.15-17.45 driving/work. Working outside a 50km radius, so no exemption for only carrying tools and materials, so you need a tachograph.

  6. Under EU rules you can have a 13 hour day, but you have to get the breaks in the right places, and actually drive/work no more than 9 hours. So if you are sitting around somewhere for a few hours of that day, and you can record that as break, you should be fine. If 13 hour days arent long enough, if you know the rules well enough it is possible to have a 15 hour day, and work/drive no more than 10 hours, but you can only do that twice a week. Should be plenty for even the most battle hardened rep.
  7. No. You must have 28 days worth of drivers hours records with you in the vehicle for inspection by a police officer or VOSA official. Btw, I know somone who have been stopped in a 7.5 tonner and immobilised by the side of the road for 24 hours for failing to comply with this. He only had 20 day worth, and the regs had changed a few months before he was stopped. Further to that, you or your employer if you are employed must keep the records safely for a further 12 months.

You dont need an operators licence for 3.5 tonne vehicles (inc transit) You may qualify for an exemption from using a tachograph when towing, but be aware that the law says you must use one, it is your responsibility to work out whether an exemption applies to you or not. Also, as I said earlier in the thread, even if you claim exemption from using a tacho, you are still required by law to keep records of drivers hours.
  10. So many things wrong with that I dont even know where to start Any vehicle over 3500kg MAM needs operators licence, and tachograph. Any vehicle and trailer combination over 3500kg Maximum Authorised Mass requires a tachigraph. A category B licence holder may drive a 3500kg MAM vehicle and tow a trailer of 750kg MAM, giving a total MAM of 4250kg. If you passed your car (B) test before 01/01/97, then you will have additional categories on your licence, including BE, for towing trailers with vehicles up to 3500kg MAM. You can check any of that info out for yourself, dont take my word for it.
  11. I would imagine that most tree surgeons are claiming that exemption, albeit unwittingly. I would be interested to know how woodchip, logs, and sweepings constitute "material or equipment for the driver's use in the course of his work" though. Perhaps you intend to reassemble the tree once you get back to the yard? How often do you go outside 50km from your base? Its not very far really, I would estimate I go over that several times a week.
  12. No, it is that straightforward. It is possible to claim exemption from using a tachograph, but it doesnt free you of an obligation to keep drivers hours records. Besides, if you dont know exactly what exemption you fall under, you are going to look a bit silly. I am continually amazed at the level of ignorance surrounding drivers hours and driver licensing. All the info is out there, and very easy to find.

  14. The truck should be plated at 5500 gross train, so towing a 2 tonne trailer wont affect the load capacity of the truck. Towing any trailer with a 3.5 tonne vehicle lands you straight in tachograph country.

  16. 1. Yes, very helpful on the phone, next day service but parts are expensive. A small plastic bottle cost me £58 the other day. 2. They do throw quite well. 3. Problems, electronics can be troublesome, especially on the no stress, heavy for its capacity, fragile plastic cowlings. 4. Never changed the blades on one. 5. Personally I think the TW is a better machine overall, the vermeer is a bit short on horsepowers to really measure up. Its really a very capable 6" inch chipper, but massively oversized so it fools you into thinking its more than it is. I would rather have a TP 250 than either of those.
  17. Dont think its a TP, there arent many firms that made screw feed machines.
  18. Ask the seller if they have loler records for the kit. If so then happy days, all the info you need. If they dont bother with loler then I would question whether to buy kit from them at all.
  19. Firm i used to work for was a member, its not a rip off, but I dont think it would be of huge benefit to me personally. From what I remember, the best thing was a free legal advice service, came in handy once or twice.
  20. I wouldnt buy an old tunnel of that design, the newer ones with straight sides are much better than the old semi-circular ones. Certainly not for a grand.

    Using a mewp doesnt make you fat, overeating and drinking too much alcohol makes you fat. Done similar off spikes, but I think I would have stripped some of the canopy off the back first, or put a pull line in with a redirect at ground level if there wasnt enough room for the digger in the drop zone.
