Complaint about my Wood Burner

It might start as a “friendly conversation” and the next thing you know you’re naked, covered in goose fat  and involved in all sorts of shenanigans!

 

(again, maybe that’s just Cornwall ?)

There actually isn't any action the council can take. You are allowed to burn wood in a woodburner to heat your house. 

I once complained about a not very near neighbour who was burning car tyres in his back garden. The Response I had from the council was that he could burn what he likes on his own property and nothing they could do!

About your new workshop,, heating it is not incinerating waste, otherwise they'd have said the same about heating your house ? 

 

I’d go with, how can I help you, what is the complaint and when/ what dates and times. Then say I wasn’t in or burning wood.

It must have been someone or something else.

 

they are just going on the complaint, and have no evidence.

 

Remember People like to bend the truth, I bet the complaint was “there was so much smoke coming out I thought the chimney was on fire”

Complain to the Environment Agency perhaps?

I'd tend to think wonky is right and in practice it would be difficult for the council to prosecute/enforce action as their powers arent strong enough.  however, the complaint will go away fastest if it is false/you do all you can to help.  So,  only dry wood, properly dry, and lots of air and fast dancing flames, keep the flue temp high.  you probably know all that.  i find smoke is virtually never visible from my flue, the occasional wisp for a couple of minutes on reload and thats it.  my neighbor burns coal, smokeless i assume, and that is clean once hot but smokes well for half hour at the start.

A diary of times and dates when lit and recharged would be a good start maybe some pictures of fuel and a record of moisture content. I know it’s a bit of a pain in the arse, I had same problem although I’m not in a smokeless zone, they even sent videos titled log burner up to log burner 5 (the return). The council spoke about burning waste etc showed my records took a while but environmental health sided with me, nothing they could do and l was within the law, they the tried to take out a private prosecution judge chucked it out. The gentleman concerned was a barrister.

A private criminal prosecution?! Or just a civil action like nuisance?

Wow, I'm a amazed the lengths some people go to when they are annoyed with a neighbor.

My common sense approach would say that arb waste which is split and seasoned certainly isn't commercial waste any more as it's gone through the process of seasoning. If you could sell it to the public as seasoned firewood then it's not arb waste, it's firewood.
