Except that, as was, without any personal financial contribution, a failed applicant could, if they were so minded, have brought you to tribunal where you would be called upon to demonstrate why 1 candidate was selected in preference to A.N. Other if it was claimed that a protected characteristic had been breached and, in all other respects, A.N. Other was equally or better qualified (on paper) for the position.

 

thinking about it, surely it's "OK" to discriminate against certain groups if they physically cant do the job?

 

I cant see a person in a wheelchair being very good at climbing trees with a chainsaw...

 

I worked with someone that was let go because he was in his seventies and literally couldn't climb the scaffolding.

That's the kind of thing I was getting at but did think it would be illegal to search in such a way however surely during interview process you could still land on such life criteria .....

 

Is it immoral to do so in your opinion?

 

It really is a mine field!!

 

Immoral? I guess that can only be judged by the morals of the person faced with the situation.

If done right, it's enough to make all but the most avidly PC never want to get involved in direct recruitment.

Got to say on the discriminatory issue. You have to be realistic.

Im profoundly deaf. I would never expect to earn a living as a sound engineer or thankfully in a call center.

If i employed a truck driver to deliver flammable fuel. Id remove the risk at interview stage and not have the smokers.

 

Back to the op.

Even if you get someone thats brilliant and pay them well, the grass is much greener elsewhere.

You only have to look at the good staff that have come from eastern europe. Glad of work. Graft well. Hear of something better, they gone.

That, no cost, access to tribunal has now been removed to great calls of unfairness from the TUs (even in the face of considerable historic data which showed a high proportion of spurious / vexatious claims.)

 

I'm not sure "great tits" would be a justifiable defence (unless perhaps it was an RSPB job application!) :blushing:

 

Makes you wonder if running a business is actually worthwhile!

Being deaf and working in a call centre would be an advantage if you rang me.

Staff issues often test the patience of a saint. If they're not squabbling amongst themselves they are usually disgruntled about something or other.

You can pay a good worker £20 an hour if you want, but that's no guarantee he'll keep with you or have his heart in the job, and on the other side of the coin some of my hardest working lads have been very happy and motivated to be paid £9 an hour.

If someone has all the answers to staff issues, I'd be interested in hearing about it.

Maybe getting good staff is nearly as hard as getting a good line manager?

 

My present line manager is a bit of a ****. I can ask him a question and he gives me a 5 minute monologue on something not relevant... He also seems to lack the consideration gene, he parks in a disabled parking bay when he's not disabled...
