  1. Im slowly working my way around everyone. I'm getting the new guys as soon as they join before they get any wiser and making a killing.
  2. Hates the sound of Chainsaws but asks for advice from people who make a living from Chainsaws.
  3. Seems like they are all as bad as each other. The Police, the Politicians, all at it all over the country. They should face heavy repercussions for telling us what to do and not following it themselves.
  4. I'll do some more digging. I did raise this concern with my own solicitor but she gave me the impression that that's just the way it is. If I put the gates up they still have the legal access. Seems like three sets of gates within 100m in England is not allowed, but there does not seem to be a case on this in Scotland. But Im only wanting gates at the start and end of my property. The neighbors are not impressed with this at all. They think its a hindrance to their business, ie the barn Conversion and the Wife's Art Studio and also a hassle for their own daily access. But within a year my small drive is going to be very busy with all sorts of folk I dont know coming up and down my Drive. I feel that everything will have to be locked down all the time. Maybe my stuff should be better locked down but we dont really have any issues where I live, but I dont want to advertise what Ive got to anyone who's passing. They still have their own drive of course. But the Drive is narrow and cars coming and going will run into each other. So I see why they are so adamant to keep a one way system. The threat of installing gates seems to be keeping them in check right now. But who knows what they have brewing, without a doubt they will be investigating their legal options. A potential option would be to install automatic Gates. I said to him that was the plan all along, and it was till I see the price of they systems. So potentially Id only install at the Road Entrance and if they want another to access their property more conveniently they can pay for the other. My Brother raised a concern of Automatic Gates and small children though. So might have to re-think that.
  5. Well this is very true. Its not really land I use other than parking when we have a load of guests over. (not often) And when Im reversing my logosol Bandsaw Mill back into the Parking area. It might put people off buying but as its so far from the house Im not sure anyone would be overly bothered with it being there? But it might hinder erecting a new fence, as the old fence is now no longer the boundary, its 500mm closer to me. And the old one is knackered.
  6. Yes, all good points. There seems very little in way of reasons for me to allow him to do it. Especially for free. He might have changed his mind now anyway and will run them up his own drive to save the hassle. He certainly would not tell me that if he had.
  7. hmmmm, interesting. £15k would be handy. Im sure he can run the utilities up his own drive, he just wants to use mine as its cheaper and he thought it was his.
  8. The whole plot was owned by a Lady who inherited it all. We started to rent the House 5 years ago. The Cottage next to us sat empty. She sold the Cottage first and the Estate Agent put up the new boundary. We asked to buy the House, but she was not interested initially and over the next couple of years warmed to the idea. We bought at a later date.
  9. I do try. Im always/was always offering him help with stuff, offering him use of my tools and equipment. Offering him the use of the Stump Grinder when I have it in, offering to move stuff with the Avant when I have it in. Simply not interested. They very much want to be left to it it seems. But where the boundary is and how its uses is on their terms only. Or so they thought. Ive told him we need open communication so issues like this dont arise. He seems to get that more now,.
  10. Might come to that. Rather just work it out to be honest. But I'll not be walked over, I don like the vailed threats either. they seem to be sticklers for the law, which is all well and good. Everything they do they seem to have taken or will take legal advice on. I know for a fact if they could force me to do their bidding though legal action they would.
  11. Thanks, which believe it on not I generally am. Ive left things for months to ensure I was very calm and collected when I raised anything with him. It generally ended with him taking the hump and occasionally storming off. He accused me of playing dumb recently, because I never said to him 'you're working on my property and I dont like it', I said I think we've got a bit of a misunderstanding over where the boundary lies and so as not to step on each others toes I think we should investigate it. He said I knew fine well he was working on my property so why did I not just say so. Cant win really. Ive been firm with him when I was home last. Let him know exactly what I thought and expected now. He came out one evening when I was digging the holes for the Gate Posts. Told me that he's giving me a heads up as he plans to get legal advice on me installing gates on my property as it affects his right of way. Seems like its BS but I said I'll leave it just now and we can come back to it at a later date when we're both a bit more level headed. Since then he's stopped taking the Lorries up my drive, he now has them sit at the road-side and drives a fork lift up his own drive. so in a way there is some progress. But it feels like a tinder box. They no longer walk down our drive to the forest near by, which they used to when they though they owned it. They have a legal right to use it and its never bothered us anyway. But the wife wont look either me or my wife in the eye now.

  13. They where nice. just very particular about their land and how they utalised it was nothing to do with me. They never said as much but its certainly how it appears and we'd only know they've done something after the fact. Which if it was their land thats fine, but it was my land and they took the hump when I raised such a triviality as tidying up a wall. Last year, till they stopped laying id drop off Chicken and Duck eggs regularly. Ive given his Oak for free to help with his barn Conversion and Ive offered him use of any and all my tools if he so needs. Just a bit of an odd couple really.
  14. I know, cheers. I'm open to compromise, but it really seems they want me to do all the compromising. Although he's taken on-board I dont want full sized Lorries backing up my Drive. He disagrees with me as he says he's always there when they come. I told him I dont know that and I have no warning its happening either. He has my number, he could give me a heads-up. He sarcastically told me the Lorries have mirrors. Very annoying. Its good to get some feedback from here. Also good to have some actual facts and figures and docs I can point to as a valid reason why I'm choosing not to allow him access to run utilities. Also, if we do decide to run the utilities Id never be able to install the Gates I want.
  15. Forgot about this bit. Yes, the Deeds give them vehicular and pedestrian access to my section of the Drive. I told him he's not backing full sized lorrys up my drive anymore though. He can use his own. he was using my section of drive as the goods entrance and return. He was not best pleased with that, I said he can get a 7.5t up and around the full length of the Drive. We agreed when they first moved in we're have a one way system for the Drive. In my entrance (no sniggering) and out his. It was their idea and one we had no issues with so just went with it. They very much wish to keep access to our drive, for ease of access to the Barn Conversion, which will be a Holiday Let and their home, and also her business (Artist) So there will be plenty of traffic coming up my drive, which I cant say Im overly enthusiastic about, having small kids and dogs etc. So my thinking was to install a set of Gates 6m in from the road and on my Entrance and where my section of Drive meets theirs. Would slow down the traffic somewhat but they are dead against that. Its still a maybe.
  16. Im not sure why he's not considered that. Maybe he has but it would ruin his garden? Easier ruining land he'll not have to see. Im not sure who owns the tree's. They are smack bang on whats the new boundary, which is 500mm from the old fence line. No idea why? So the trees run through the middle of this. Yes, I hope we can resolve it amicably. We got on well before. No, they are the only ones. But they seem hell bent on encroaching on my land. As mentioned earlier at the rear of the property is was as much as 3m across my way. They've agreed that they where wrong, but without saying as much. Cant admit they are/where wrong or apologize about it. Not that Ive asked them to, just very defensive about it all. Said my wife was spying on them for taking pictures of work they where doing to a drystone wall thats on my property. They thought it was theres, its not, They agree to that now. but cant see the issue. They sarcasticly said sorry for making the wall look better. When all along Ive simply asked to clarify the boundary with them, to walk the lines and get a surveyor in (that Id pay for) so we're both happy. Which they refused.

  18. It is an option yes. I want to remain/return to being amicable. Ive given them Duck and Chicken eggs since they've moved in. Ive given them Oak for free for their barn Conversion. Ive offered him use of any and all tools I have. They are a bit funny though. When they thought the land was theirs our views and opinions counted for nothing. He was very clear on that. Ive only just put down 40t of Chuckies as well.
  19. I might do that. Will see how things pan out between us. Relationships have deteriorated but I dont want them to deteriorate further. He did mention the alternative is to run the utilities under his Driveway but he was clearly not enthused by that prospect. Interesting. What is considered huge? OK good. Yes, I'll maybe mention that to him. I know. He's clearly planned this when he thought he owned it all. He's been in there for 3 years but clearly never spent much time looking at the Deeds. He was adamant he was right and when he found his Deeds he had to back track. Could not bring himself to appologise though. Just changed what he claimed he said before. But it was all via text message as I was in Norway, did not like that being pointed out.
  20. I assumed it would cause damage. If I’m pushed into accepting this to go ahead (for whatever reason) is there any precedents in place for demanding some form of written liability due to damage caused by these trees falling in the future? It is the cheapest and easiest route. Especially considering they thought it was their land and my consent was not needed. He mentioned taking the utilities the long way around. As you mention up the blue section of the drive and around the back of his house to where the yellow line terminates. He was clearly not wanting to do this and seemed adamant he was still planning on going the way he planned. I’m assuming he can’t force access over my land to instal his utilities? We’re in Scotland, if that makes any difference. Things have now gotten quite frosty between us. They have lost what they thought was their drive and also had to move their boundary at the rear of the property nearly 3 meters back towards their property because they read their deeds wrong. I suggested we get a surveyor in but they refused. In the end their own solicitor told them they where wrong. I’ve held off installing the gate posts at their request as they are vivid at the thought of having to use a gate to access their property via my drive. They tried to say it’s not legal to have two sets of gates within 100m of drive. But it turns out in England you can’t have three sets of gates within 100m and there is nothing in Scottish law that states this. He gave me a vailed threat regarding how many trees I’ve removed from my property as well. ? Mostly Spruce and some small spindly Cherry, Beech and Birch. Asked if the council know I’ve removed them. I told him I’m allowed to remove 5m3 a quarter and have it all logged. But I know he’s gonna raise this again. What I’ve removed during the last 5 years is certainly within this amount.

  22. So Im having a discussion with my neighbour and some of you guys might be able to help. My neighbour and I share a Driveway. I own part of it and he owns the rest. He was under the impression he owned all the Driveway but has accepted (after some legal advice) that he does not in fact own the section I have said all along is mine. Anyway, as he thought he owned my section of the Driveway, and the small strip of land on the other side of the drive closest to his property he planned on running utilities, ie Water and Electric from the Main Road up to the Barn Conversion he is doing along side the Driveway he now accepts is mine. He is still under the impression he is still running his utilities here but knows I have reservations. He only informed me he intended running his utilities over my land when he seen me digging a hole to install Gate posts. He said I cant install Gate posts there, there thats where he'll be running his utilities. The Brown section is my Drive (and strip of land) and the Blue Section is teh same drive, just his section of it. The strip of land he is planning on installing the Utilities (1 meter deep) is sandwiched between the Driveway and some tree's. These tree's are 2 meters away from the driveway. The Trees are a mix, including some Scots Pine and sycamore. The Scots Pine has to be 50-60 feet. As he thought the land was his he had no intention of informing me of this. But obviously now he has. The Trees themselves are smack bang on the Boundary line. We've not even looked into ownership yet. My (long winded ) question is; Is there a danger in digging a 1 meter deep trench along a row of trees within 2 meters of them now or in the future? Would this cause the trees to be significantly weakened and have a real potential for them to blow over? Or die? If they fell they would easily fall on my house, and theirs depending on which way they went of course. Basically he wants to sink his utilities roughly where that 8" Oak Post is now. In the plan below Ive drawn (badly) in Yellow where he plans on running the utilities. The Black dots are kinda where the trees are.
  23. So your suggestions are not aimed at us? Have you thought about telling those that actually need to heed your sage advice your thoughts on the matter?
