The Law states that if you Intentionally or recklessly disturb any wild bird listed on Schedule 1 while it is nest building, or at a nest containing eggs or young, or disturb the dependent young of such a bird.   11. Apart from prosecute you under the Wildlife and Countryside Act 1981 with amendments... The maximum penalty for each offence in the Magistrates' Court is a £5000 and/or six months imprisonment and a £5000 further for every egg destroyed.

Any removal of the arisings without the owners consent could constitute an obscure form of theft known as 'conversion', unless the tree owner has a particular need for that material, it is unlikely they would make a complaint.   13. Leaving the arising is not ‘silly revenge’ it’s the correct way to do things legally, just like your Common Law Right to abate nuisance, the brash always stays with the owner, it’s his property wether he likes it or not.

As others have said very little research into the extent of root systems has taken place, however it is clear that they extend well beyond the 'drip' line and within the top 30cms due to oxygen limitation. Another point is the consideration of mycorrhizal fungi in the surrounding soil. I think that the 12x formula is in place of nothing - a line in the sand, it probably should be increased, it isn't really simplistic, but it acts as a yardstick, I am pretty sure that anyone who wanted to do a really interesting PHD could use modern technology to plot and monitor actual root dimensions, but at the minute I cant afford to give up work - unfortunately.

  24. Ok so a few comments - the TPO maps should be online - it makes all our jobs easier! I have knocked back applications recently (hence my first reply!) in situations were it has been pertinent to make sure that the specified trees, that were in a group with non TPO trees, were marked up so there was no confusion and there was a need for clarity. You need to remember that as a TO we make recommendations to Planning, but as it is a Planning function they make any decisions, we just advise and send comments. Just a final comment, if we want to be treated in a professional manner, we all need to act in a way that takes away any ambiguities and areas of 'woolyness', including submissions and paperwork. We all love a rant and a good steam, but we have a policy of putting the phone down on people who do are abusive or aggressive - that proper winds them up!!!
