Won't comment on the case, however the Condition for the replanting of the tree is part of UK Law, in the Legislation it states – The Duty to Replace Trees 11.2 Under section 206(1) of the Act the landowner is under a duty to replace a tree which is removed in contravention of the TPO. Outside woodlands the duty also applies if the tree is removed because it is dead, dying or has become dangerous (for more advice on the replacement of woodlands see paragraph 11.11-11.12 below). 11.3 The duty on the landowner is: (1) to plant another tree, (2) of an appropriate size and species, (3) at the same place, (4) as soon as he or she reasonably can.

  4. It is forbidden to kill or injure bats, disturb them or to obstruct or destroy their roosts (even if the bats are not inside). Breaking these laws could incur a fine of up to £5000 per incident or per bat, up to six months in prison and forfeiting the equipment used to commit the crime.

  10. Something tells me your Councils money issues will soon get a boost of around £20,000 and a reinstated TPO'd tree at cost to yourself (if its PTO'd of course!)
  11. Trees displaying evidence of roosting bats or evidence of badger setts near should be referred to the Local Authority Ecologist before any work commences. Any trees confirmed to be supporting roosting bats or live Badger sets will not be worked on until Natural England is consulted. You would then need an Ecologist with a Bat Handling License to confirm.
  12. 2 years ago we had no Ash dieback locally in the North West UK, now it is in 90% of the Ash I see and also within masses of regrowth young trees, all showing diamond lesions. I wonder if many Council Tree Officers are still TPOing them?

  15. Arb Association states - Crown reduction cuts should be as small as possible and in general not exceed 100mm diameter unless there is an overriding need to do so. Reductions should be specified by actual measurements, where possible, and reflect the finished result, but may also refer to lengths of parts to be removed to aid clarity, e.g. ‘crown reduce in height by 2.0m and lateral spread by 1.0m, all round, to finished crown dimensions of 18m in height by 11m in spread (all measurements approximate.)’. Not all species are suitable for this treatment and crown reduction should not be confused with ‘topping’, an indiscriminate and harmful treatment. Most Tree Officers have moved away from the percentage game as, in my experience it can be misinterpreted at best, one mans 20% is anothers 60%. IN terms of Trees in Conservation Areas it is my understanding that its a straight Yes you can, or no you cannot, which would then lead to the placing of a TPO. Hope that helps, the caveat being this is in England.

  17. 100% Mistle Thrush, no warblers are singing at this point in the year and only Blackcap and Chiffchaff overwinter. If you think about it its sounds like a Blackbird, not as melodic but has that deep, thrushlike chucking qaulity, they sing in all weather and the old name for them was the Stormcock. In terms of Redwings and Fieldfares we have poor numbers here in the North West, most birds didnt come across in any numbers and were locked up on the East coast

  21. Okay, thanks guys, sorry to mither and its definitely not Meripilus, it was as near as I could get so no idea about gills/underside and hence the crap photo! I was thinking very old Fistulina - beefstake, but not 100% convinced, and seldom seen ot on Sycamore around here in the North west?

  23. Hi all, found this morning on Sycamore would like opinions if possible, I have my own theories but never seen it on Sycamore!
  24. In fairness he is a physicist and 'top boffin' so probably risk assessed and took a very scientific approach! One of my kids got me one of his books once, first chapter okay but during chapter three got a Migraine and a small trickle of blood came out of my nose...
