  2. Common sense. Don't get me started on common sense. There's no such thing. Common sense is only what a majority believe that it is and my issue is that an over zealous protagonist may claim 'disturbance' and the defendant has little assistance in legislation to defend themselves. I read somewhere, IIRC, that in forestry work Badger setts must have a 100m exclusion zone around them, to prevent disturbance. At least that is empirical and everyone is clear on what they can and can't do. Apparently after Brexit, that's all going to change
  3. You read correctly .. nor in trees within 10m. This is where I'm struggling to get answers. Is anyone claiming that a nesting bird won't be disturbed in a tree 10+ m away, but will be classed as being disturbed at 9m away? And surely the disturbance probability is also species specific? Lots of people report Robins nesting in stupid locations like flower pots in garden sheds. Is it reckless to use the shed as normal (because the bird seems accepting and carries on). Some of the legislation seems very poorly defined and open to interpretation, so even if you try to be compliant there's not much in the way of guidance to how to do so.
  4. I wonder what the legal definition of disturb is? Could a window cleaner be prosecuted for putting a ladder up below the eaves when a House Martin is nesting? Back when they all used ladders..

  6. I helped plant a retail park beside the M62 near Leeds in, I guess, the early 90’s. The artificial berm had been compacted to death by 360s and we were planting plugs with heavy pinch bars, thinking nothing would survive. Drove past the site last year and the park is totally screened by trees - nature’s wonderful. Also feel old, in that I’ve helped to visibly improve the landscape.

  8. It's not just conifers, although loads have been burnt, I've seen some mature Eucalyptus damaged and loads of small evergreens. Not too many deciduous trees in leaf yet so we'll see.
  9. Might it be better to see how the tree recovers/produces new foliage first? Answer might depend on how busy you are.
  10. Not sure where you are in the country, but could the cold wind/low temp have killed the flower buds? ive never seen as much ‘burning’ of foliage as I have in the last few weeks. It’s really noticeable of conifers and evergreen trees and shrubs.
  11. I'm not saying that you couldn't do it, just warning anyone that's thinking of doing something like that.You pay your money and make your own choices.
  12. You could, but train drivers get very excited when they see people up trees near lines (and I think that they decide when near is too near, not you). A visit from the transport police will slow your day down rapidly.
  13. I seem to remember that Kevin Johnson had some dealings with Network Rail, after making some sort of enquiry he became the 'notifier' and then they decided that he was responsible for everything thereafter.

  18. What's your personal opinion Paul? I can't help but find it strange that the practice is acceptable (not saying I wouldn't do it if the chance arose).
  19. That's the one. Interesting chapters on climbing in it. I think I posted a couple of sections out of it a few years ago, about not being full of bravado when climbing trees
  20. Can't see an issue, the intent is to encourage decay and habitat niches in those circumstances.

Not a first edition but a much later reprint (unfortunately because the first edition is a beautiful book) Hartzig A pathology book from around 1890 A 1900s book on Arboriculture by a fellow called Seur or something - not got that to hand. i know, I need to get a life
