  1. ok been chatting a bit and a option has been raise. SIL would sign over her share to myself providing the folowing: We get the company valued. What ever the value is 50% will be paid to my neice if and when the company should cease to trade. I will employ the SIL to do all accounts, tax returns etc. For this she would receive a monthly wage ( arguments sake £350 PCM). All other money generated she would have nothing to do with. This is not set in stone in any way and i will still be seeking professional advice. Cheers
  2. thank you all for the advice. My brother didnt have life insurance. He was a bit fly by the seat of his pants kind of guy i guess, lifes knocks never held him back or down. I guess he proberly felt like this kind of thing just wouldnt happen to him! His wife use to help a bit with the accounts, but not in a big way. My brother use to do all the date input, invoicing etc himself and his wife would help him to have it correctly files in excel spread sheets. This was then sent to a independent accountant. My feelings are very much to try and buy her out of her share so to try and keep things clear and fair. i would hate for money to become a source of conflict between us. The company is only small, it was just the 2 of us with a subbie in occasionally work depending. We were trading as a partnership but tbh having a partnership will ( for want of a better word) never crossed our minds! In terms of contracts there are none. We get some repeat customers but they still get other quotes and go with the best prices most times. So i dont know how much value the name could command? We have always sold our bussiness so to speak through us, our personalities. The face to face time when quoting. The Name and equpiment really only requires money to achive which anybody could do i guess. It was only 3wks on sunday that he died, his funeral was on tuesday the 7th so yes we are all feeling emotional. But also i need to sort this out because as i understand it everything we have earned up till now if half his wifes, but if i carry on working and paying into this account then she will be entiteld to 50% of everything i am earning without my brothers help/input. As many have said i want to do fair by her but it cannot be at my families expense. She is still earning her own salary and will also get my brothers share of the money earned and also all equity of his property.
  3. Definately need to get advice. We are not a limited company. Not only did I lose my brother I also lost a lead climber who also did a solid 50% of the quotations , admin etc! A major concern is that the recession seems to caught us up this yr, out earnings have dropped well over 50% (not our fauly really the company we subbed for lost their contract so we did by association). So where we did good last yr, we are down a lot but will the company be valued on last yrs takings? If so I am screwed!
  4. Hi all. I very recently lost my brother and business partner In an motorcycle accident. Been a happy lucky going guy we never had anything in writing about if something should happen to one of us. We were so close that everything we did was 50 50 and work and finances etc were always fair without a shadow of doubt. Since he passed away without any will or partner ship directions his half of the company goes to his wife. Now i get alone well with her but I worry that I don't have the knowledge required to ensure that we both come out of this situation fairly. She is an accountant and tbh can baffle me with the lingo and her knowledge. She has suggested that the company pay her a monthly wage and also 50% of the annual net profit. She would not have a role in the day to day running apart from the odd hand to advise me on data input. I am thinking it would be better to buy her out of her half of the company. I am after advise on what's the best way to work out things like how to value the company etc. I am not looking to cheat or hide anything because she is family, my brother left a 8yr old, my niece whom I will do my best to help raise. I just want to be informed as I too have a wife and 2 kids and don't want anything stupid to ruin their relation ships with their aunt or cousin. All and any advice greatly appreciated!

Thank you all. It's so sad and frustrating as we were 30 secs from his house. Blink of an eye and my world has been turned upside down.
  9. 99% of u dont know me but myself and my brother r both tree surgeons and i have been here a while. Just to let u know my brother was killed in a motorcycle crash this morning, leaving a child and wife behind. Please take care out there if you ride bikes and keep an eye out for bikers if you dont. He will be greatly missed by all that know him. thanks
  10. i have done 11k already and its not bad, use to do a lot of miles going into london which tires you out. I cant knock it tbh. Land rover. Contrary to what most people say they r not reliable and cheap to fix unless you are a seasoned landy mechanic. I had a 130 as my first truck and ended up spending a fortune on replacing just about everything over a couple of years. I lost track of the number of garages i went to to get it fixed. The irony is that the ones claiming to be land rover specialists actually turned down the work, more interested in discoveryies and range rovers. Cost me loads of money and stranded me a number of times. And a friend had a new one ( now about 3 yrs old) and has been back numerous times and let him down repatedly. Only good thing is they r god off road.
  11. Hi Duncan i am getting on fine with mine. Had a power steering fluid leak which warranty sorted out. But then i had a new transit that had a fault where a bit rubbed through a coolant pipe and drained all the coolant which is more serious an issue tbh. this is a recall issue on the transit to repostion the pipe. only other problem is the door handle comes off ( on my third now) but they have not designed a fix for it so as and when it goes they repalce it free of charge. Have got use to the truck, have learned that one needs more juice for pulling away. Gears are a bit stiff only when cold, after a 2 min drive they are fine. Hopefully the pykies will stay away from it as they ted to use transits only. Oh and as u say its a lot cheaper to buy!
  12. i use to have a £7000 car which when new was £35000. it was standard with a factory 2 tone paint job and a loud engine (4600cc V8). off the bat people were putting me down to charging too much. If i had turned up in a 20K land rover then they think 'thats the right bit of kit for the job!' So it can make a big difference. We have a new truck to enable us to work in london (emission rules) and the number of times i have been told i am making too much money is unreal! I always repley that i dont actually own it yet until i have made payments for the next 5yrs! They get the point then ( in a polite way). Uniform always have your logo showing and i dont dress too smart. ( no suit) If a suit come to the door i personally would be put off. And take off your shoes!
  13. Sorry been away from the pc a bit. TBH i dont know if his insurance pursued it but know them companies they do normally. I have not been back to that client so i cant get any updates. But i would have thought it would have been a clear cut case and the council would have no room to maneuver. I mean if a tree report is done and they blatanly refuse to consider the advice then they should foot the whole costs and consequebces. Will keep the info in the back of my head for the future though. Cheers
  14. He did try to argue and thats what they said in efffect. in the end he gave up as his home insurance did pay out.
  15. Like they said gather as much info as you can. had a similar situation where a tree report was done, advised removal of a oak due to root decay. Council tree officer refused it. 1 month later fell over onto the adjacent house and 1 day old car. Guy had to claim off his house insurance. council said not our problem and that was that!
  16. The company is local to me, the owner is a very nice chap, works hard and is honest. HSE mistakes aside like has been said there is no accounting for stupidity. He employs a lot of school leavers which i think can be good as often they are shunned for their lack of experience. ( cant get it with out a job- vicous circle really). The various trades he offers he runs as completely different businesses, just groups the together under the one name.

    L200 advice

Cool I havent been to see him what witht he snow and ice i cannot be bothered to take the risk getting to see it. I know it needs at least 2 new tyres from a previous quick look but thats as far as i have got with it. Need to get some Chunky tyres on there as it will definately go off road once in a while. Probaly look at getting a package deal if pos on some wheels and tyres. Def will be doing some negotiations on the price if it goes that far. Cheers
  19. still white down here in berks. Maybe because we dont get much snow here but i do ove a bit of the white stuff (snow not the illegal white stuff:001_smile: ). I know that no work means no pay but everywhere is quieter and more peaceful it seems. and the kids love it!

Sounding good. But should i worry about the low mileage? I looked it over from the outside but the dealer was away for the day so couldnt get into it in more depth, especially things like cambelts etc. cheers

    L200 advice

Hi all Looking to get a 4x4 ( tax purposes and also access to field to do logs). Need a double cab as i need it to lug the kids around too. I have seen a very clean looking 2005 l200. 24000k full service history and 1 owner, but the dealer wants £6995 for it. Now i know that the trucks seem to be holding there value a bit not sure about 7K. Also the main thing i wanted to ask is would you be scared off so to speak by the low mileage? thats about 3k a year. I am sure i have heard before that too little mileage is worse than to high. Not too keen on the new shape trucks tbh and i plan to do smaller log deliveries so not wanting to spend a fortune on a truck and then chuck logs at it. Any advice would be much appreciated. (Oh and it must be black as is my company colour:001_smile: )
  24. garth where abouts r u just out of interest?
  25. I have a loud alarm which has the flashing lights. its motion sensor and also instand contact breaker so the second you get in its off. have neighbours looking over it too but unfortunatley this doesnt man much. looking into cctv but have this thing in my head that the police dont care even if they r caught on film. this is reinforced by a thread where someone is having wood nicked, got them on film but the police r just not interested in pursuing. unfortunatley there is public access to the building at all times. we kind of work on a more of a out of site principal as from the outside there is nothing to give away whats inside.
