  1. If you think groundwork is laborious after 4 months, I think you will soon get fed up of cutting firewood.
  2. I've seen worse, give it a couple of years to put out some new growth, then get someone more skilled to reshape it, would be my advice.

  5. Only 3 of us on site, so no written RA. If there had been one I could not have put “trained in fence climbing”🤣 He was not asked to climb the fence. I’ve just come to accept that I’m responsible for the actions of anyone under my direction. The time of personal responsibility and common sense is long past. Just make sure your properly insured. Or better still just do everything yourself 🙂
  6. IME, they will find a way of making it the employers fault. I had a subbie groundie working for me. Only the third day he had ever worked for me. I was dropping a Pop on the boundary of a school playing field. Some branches went over the other side of a small fence, The lad climbed over the fence to retrieve the branches. Upon returning over the fence. Rather than throwing a leg over the fence and then swinging the other leg over, supporting his body with his hands on the top of the fence, as I would have done and did go on to do later. He stood on top of the fence, his trousers got caught in an upright, he fell forward and broke his leg. No-win-no-fee claim landed. It was decided I was 60% responsible for the accident, as I had failed to proved fence climbing training or a ladder. Whole thing cost £18K, I think he got £10K. My premiums did rise, but not massively. Although back then (2004 I think) there were very few insurance providers for our industry and prices were crazy. I think I was paying £6.5K for £150K turnover.

  8. While I agree with the sentiment. Would you really just let it run.... people dying hospital carparks, ring 999 and getting an engaged tone and an ambulance never arriving? NHS works just walking out as they cannot cope etc, etc?

  10. The lockdowns have got us to point where we are now rolling out the vaccine, without the NHS imploding. You accept the infection rated fall during the lockdowns, so in what way are they not working? Perhaps if less people railed against them, online and elsewhere, there would be far less flouting of the rules. We all know that vast numbers fail to adhere to the lockdowns, yet they do still reduce infections. Imagine how affective they may have been if people had got behind them willingly and strictly followed the rules and advice.
  11. Unless the law has been changed in recent time, once you have allowed a manufacture or supplier to carryout repairs to a product, you cannot then demand a refund or replacement. If a new product is faulty you can demand a replacement or refund rather than accept a repair, but once you accept a repair, your right to a refund is lost and must allow continuing repairs. Not very fair IMO.

  14. If I were you I'd make sure I'm covered by my MY insurance, if it turns out the freelancer's insurance covers it, happy days, but either way I will sleep easy.

  17. Are you really that stupid? I had you down as a pretty smart guy. With or without lockdowns other health issues were always going to be a casualty. Had there been no lockdowns the NHS would have been overwhelmed, leading to the cancellation of other treatments, plus many more, probably more unpleasant deaths. Each time restrictions are lifted, infection rates grow, if you don't believe this, I can only hope you have a long and happy life on the flat earth we all enjoy.

  19. Spot on!! I've lost count of the number of times I've quoted a sensible price of say £1100+VAT, the customer is happy and ask us to carry out the job. Then some clown turns up and quotes £600. Obviously the punter bites their hand off and cancels us. No problem, but what fools the other Co are. The customer and I have already agreed the job is worth £1100+VAT, so all that's happened is the customers has made a huge saving and the other Co is working for peanuts.
  20. If it’s my job, my name on the invoice, me getting the bulk of the money, me deciding when the job is done, etc, etc, it’s ME on the line and hopefully insurance will cover my arse. Could I breach the terms of my insurance, by using untrained staff? Of cause I could, but that does not magically make it the financial responsibility of any person “working under my instructions” unless I have subbed out the job completely and they then call the shots and carry the can. This was all done to death more than 15 years ago. When HMRC clamped down on labour only subcontractors. At the time I was a subby climber, I worked for various firms, including Fountain forestry. I got a letter from the tax office saying they where happy I was genuinely self employed. But Fountains where scared of their tax liability and where making no exception. I bough a chipper, got a groundie and subbed into them as a small gang.
  21. I don't believe insurance companies take your tax status as a means of determining liability. HMRC and insurance Co's are very different and see things differently. I also don't believe some of the stories being told in this thread.
