Is it actually against the law to use a topper on the ground ? Coz if it isn't then I think every one should carry on doing what they are happy doing FFS . Those who don't want to dont those that do go right ahead .

Not against the law but it can be seen to be not minimising risk to use one. I have not seen a prosecution yet.

However there are many instances of successful prosecutions, some even using third party photos, of things like scaffolders not using edge guards, i.e something to prevent slipping off the edge even if guard rails would prevent a body falling through.

I like to have a small battery saw next to the chipper but would be very wary of using it in public.

I used to do it a lot before they made it against the law

So there`s the last stick that wont quite go through the chipper and the groundsaws are in the truck 50mts away but the climbers saw is just sat there winking at you............:laugh1:

Edit. You are right of course.

Perhaps we'd all like to go and get tickets for the tools that we use that are the 'professional kit' of other trades?

" You there, Treeman. You can use a chainsaw, but you must call a grown up if you want to change a brake pad, put up a light fitting in your workshop, make a weld, stick some Celcon blocks together or put a structural fixing into concrete. There's a good lad now,"

There are a lot of things out there that carry potential for injury or a liability claim. Perhaps we shouldn't bleat about others using 'our' kit or carrying out 'our' techniques.

It's not a medieval Guild with closed trade secrets.....

Yesterday I used a top handle on the ground (with both hands) for a couple of cuts to prep some branches for the chipper. I also (free)climbed into a small tree about 4ft up to make a couple of silky cuts. My foot slipped and I nearly came out much to the amusement of my crew. Would have served me right. I realise that "one offs" in regard to safety infringements go on all the time in every industry. That small slip reminded me that as the team leader I am setting the example and others will follow. I've worked hard to establish a culture of care and safety in the business I run and was reminded how unsafe working practices can "creep" into the workplace.
