  2. Yep that seems wise there seemed to be a too many " It Can " or "may have" in the original statement for some peoples personal satisfaction / comfort , as if an " it can " happened when its stopping the thing stopping you from hitting the deck, especially when you might not want it too..

  5. No you dont you can create your own policy , given that in doing so it meets with certain Statuory and regulatory standards. The Mhasaw act gives guidance on what you need to do ,, basic up shot being ,that you will ,, assess works processes for hazard and ascertain the level of risk, identify those who are potentially at risk from the hazard , that you will put in place those measures and controls to mitigate or reduce the risk , including ppe training correct operation and maintenance , have a means to record your findings and that you will review them on a periodic basis iain

  8. there's not much worse than a dead Pop' , apart from a live pop' . weak timber strength , often weak unions, they snap for the fun of it I have climbed some real nightmares in my time , split stems on co-dom's and sigular stems sometimes needing additional supports to ensure viability to perform the dismantle Yes of course do what you can by employing on ground methods, or Mewp or cranes by the fact they are still standing upright Dead trees are displaying some retained structural strength , if you remain withing the core stem and dontattempt limb walking then you are in my experience fine , use extendable pole to position and place lowering ropes, take your load weight into consideration, dead wood doesnt react as live timber so reduce loads accordingly , slow and steady does it, live timber with structural weakness are often more unpredictable as the load and wind sail effects get your mind buzzing , let alone your butt muscles twitching.. on our website the galley shows a co-dom beech which split at the point of crown break and the split was radiating straight down the stem , two HV lines, two roads & a river the bugger was in leaf and we craned it down I have never been so mentally exhausted dismantling a tree as I was on that job.. Hi All responses from both Nptc and hse Nptc Hi Iain It is true that if an operator holds an nationally recognised MEWP operator ticket and also CS39 or the new equivalent that this would cover them to operate a chainsaw from a MEWP (CS47) ‘in the eyes of ‘City & Guilds and the Health & Safety Executive However, there are a number of local authorities here in the UK that do not accept this and insist that all operators needing to carry out this task hold CS47 and they are perfectly entitled to do so. HSE Hi Iain Just to confirm that HSE's interpretation is the same as Kerry's i.e. someone using a chainsaw from a MEPW can either have CS 39 ( or new equivalent) plus IPAF or similar ticket or have CS 47 ( or equivalent). Clients however can stipulate which they prefer.

Hi sorry I missed this thread , as far as I am aware , if an operator holds a mewp ticket i.e. Ipaf relevant to the machine being used & that the chainsaw operator also holds cs 30 31 38 cs39 then the cs47 is surplus to requirements I will contact Nptc directly to get their comment though rgds Iain

I've got to agree La spending is off the wall , many of us know of the March silly season where councils suddenly realise they have spare cash to spend before the financial year end and get schemes ordered before they lose the money Why ? because they dont actively control budgets Why ? because its not their money Why ? because they can put rates up again next year One of our local councils has spent millions putting up a vertical pier to attract vistors into the town so that they can climb up the pier in order to gaze out over the sea & the 40 huge wind turbines set up in the inner coast line D'oh what a marvelous attraction thats is !
  17. oh okay never mind, I must have got it wrong . NEW Hse intervention fees are now in place and they dont make new income related rules for the fun of it , in the same way speed cameras are really there to keep speed down !!!! NOT irrespective of the rules its all subjective, when folks are pricing out a two man team for £120 a day , as for some clients it seems price is king , so perhaps some are happy to say or have to say balls to the safety , quals and insurance as the price is the leveler in all things & they have bills to pay mortgages to meet and familys to feed , irrespective of the clients equal statutory obligations........ which is that they are equally liable in the eyes of the law, for the safety of those which they engage to carry out their service. perhaps time will tell ... I wont be contributing any further, take from what I have posted as you will , good luck

Cs arent the law however there are plenty of laws and regulations HSW 74 act covers lots as does Puwer 1998 regs Loler reg 98 etc this isnt a direct quote but its along the lines of : work is an act 'that' which a prudent person may reasonably expect to pay / be paid monies for providing / carrying out 'that ' service. In puwer reg 9 All people using equipment at work must be adequately trained to ensure health and safety in its use, supervision or management. Some work activities require detailed formal training but, for most everyday activities involving work equipment, adequate training can be delivered in-house using the manufacturer's instructions and the background knowledge / skills of more experienced workers and managers. Chainsaw operators: 'All workers who use a chainsaw should be competent to do so. Before using a chainsaw to carry out work on or in a tree, a worker should have received appropriate training and obtained a relevant certificate of competence or national competence award, unless they are undergoing such training and are adequately supervised. However, in the agricultural sector, this requirement only applies to first-time users of a chainsaw.' People should be competent for the work they undertake. Training – along with knowledge, experience and skill – helps develop such competence. However, competence may (in some cases) necessarily include medical fitness and physical / mental aptitude for the activity. Training and competence - Work equipment and machinery + then if you dont have the quals , can you ge the insurance ># and if not is it not illegal to trade as a self employed person sole trader if you can not provide public liability cover + tree work if doing as a start up you cant do it on your own so will need employers liab, which could well be invalid as if an accident is caused in the work place by the policy holder and they arent qual'd then thats a nightmare waiting to drop on your head + if acting as subbie then need prof indem and public liab & the employer would need to follow puwer reg 9 and as not to invalidate their on Emp liab they need the subbie to have satified reg 9 puwer

An interesting thread are assessments in need of "tightening/stricter" ? assessments are carried out to a set known standard on that day on demonstration in those specific site dynamic / conditions , much in the way an mot is carried out on that day .. but once the MOT is issued you could in theory not manage or maintain the vehicle for its parts for another twelve months [ not with standing the construction and use or highways and #Vosa legislation] Do we need more ? firstly can businesses afford more training and assessment ?? after all these things cost money not only fees but the wages of the individual and the loss to income to the business whilst the training and assessment is undertaken For experienced operators or those trained in house of course Assessments can be taken without any formal training in so far as the candidate & employer believes he/she will reach/meet the required criteria.. however if that person fails then the short route isn’t perhaps the best BUT AND this is a big BUT employers having spent money on training, assessment , wages and taken a hit on productivity cant stop that person leaving two days later and working for themselves or for their competitors down the road who will pay more wages ,[ which they can pay as they haven’t laid out the above expenditure SO do we need ??? is one question a wholly other is Will or can industry afford to PAY ?? after all Nptc is an assessment of that candidate on a given day and is not an assessment of Excellence but of their competence to a known national standard which are agreed by those in ivory towers somewhere who who sit on such panels criteria taking in a wide spectrum of Tree industry dynamics ,, not solley those of the Urban arborist Do I agree one size fits all ? NO should we have a base of competancy ? YES which can then be developed on ! a fork in the road divergence !! to meet the use of the chainsaw by the operator perhaps either toward the forestry setting or the Arboricultural setting two totally different environments So can we as chainsaw holder of Cs31 say we have been assessed to fell a tree in a forest YES as thats where we do our assessment BUT can we say we where in the urban setting where the dynamics are more demanding NO
