Legal action against company

Hi everyone, 

 

This isn’t something to do with a company or person not paying but more looking for advice/opinion on a company that providing a service didn’t deliver at all. 
 

So this all makes sense had a lead generation company set up an ad campaign for myself. They said first month will be hit and miss which is understandable. But in month 2 and 3 they was producing leads that were 100-200 miles away or you’d ring and they didn’t even want a tree surgeon just wanted a painter or something stupid. 
 

they kept promising they would solve it but they never did and I never bothered renewing after the 3 month trail. Plus they said they would use Google ads and I signed up for the use of Google ads but in the end they used Facebook ads as they felt this would work better. I just feel this is false advertising. 
 

I understand that lead generation doesn’t provide leads or results but they have just produced spam and kept blaming other problems. In the end I had to teach myself how to use Google ads and produced really good results which is frustrating when they kept giving excuses when I could do it. 
 

would you reckon taking legal action for a refund for being missold a service and a service that wasn’t even working. Or am I just better off walking away.

One problem is that you are not protected by consumer rights legislation, as you are a business - so if they have fulfilled the fine print in the contract then you have no leg to stand on. Maybe take some legal advice about whether there is a contractual case to answer, but even that is going to cost £250 an hour.

Legit companies are struggling to find work.

How an earth did you think these scum were going to do any better?

Mick has a good point. Unless there were guarantees made you're going to struggle.

 

Not saying it's not possible, but it depends how much time/ money your willing to risk. You could easily spend more than you hope to recoup before you even get to a court claim.

Just count your lucky stars you weren’t tied in to a years contract, that’s how these companies usually work. 
 

No cooling off or other consumer protections for business to business.
