  2. It's a 12hr round trip for me (according to AA route planner.) Traveling up on the Tuesday so as to have a few beers & a steak dinner the night before!

Tricky when you're representing someone else (or indeed yourself - you never know who's watching / listening / recording) A difficult situation under those circumstances, perhaps just laugh, say you're tendering to the council and suggest he sends in a CV to see if he can challenge for the tender. At the very least I'd want to laugh in his face.

  6. Everyone was waiting to see what Jules had to say! Sounds like a classic "people management" rather than tree / hedge management situation. From a distance it seems ludicrous that the neighbour has gone straight to the letter / threats of ASBO approach especially since they are not empowered to issue an ASBO and the route to get there (if at all) would likely be more expensive than offering part or all of the cost of remedial trimming.   10. The mechanism to prosecute JL under the circumstances you describe above already exists. But as you also say, the likelihood is very slim! That just demonstrates an unwillingness / inability to enforce rather than an absence of legal recourse.
  11. Agreed, you can be prosecuted for exposing yourself to unnecessary risk, plenty of examples of prosecutions.
  12. Just found the thread and read through from start to finish. Shameful behaviour from shameless dog owners. I'm not normally one for what might be thought of as liberal tolerance of anti-social behaviour, quite the opposite really, I'd support birching the offenders, but in this case, and given the previously mentioned million £ price tag for damage, perhaps installing a purpose built "pulling stick" of steel upright and rope or wire dangly bits might be more effective / attractive than a random tree? Certainly be cheaper than the notional 'cost / value' of the damage? I know it could be seen as encouraging a behaviour that we'd probably all rather see eradicated but just throwing it in as a possibility - even though I couldn't imagine it being approved - can't see the bamboo lasting long! I have a dog with a rather unnatural desire to climb, but generally she's just happy to be up there and does't bite the tree.

  15. 👍👍👍 Difficult to justify any kind of 'business case', make a return on your investment or establish income generation. Unless it's hobby / DIY (which is great - and addictive) Personally, I'd say there's not much chance of earning a crust from it!

  17. Sounds like a potential litigation nightmare waiting to happen? So if the tree contractor is directed to carry out a work spec provided by the insurance company, presumably after they have commissioned appropriate expert surveys, what, if any, liability might the tree work contractor bear if, at a later date, it is proven that the tree work conducted has exacerbated the subsidence?

  19. There's an opportunity there for the taking.... If the homeowner is content, ask if you could have a contact number for the insurance assessor, give him/her a ring, get your clarification and talk about industry recognised job description terms / spec's, might give you a good contact with insurance company!
