A bat roost is protected whether or not it is in use at the time. If there is evidence of it having been used, I would be inclined to think any removal of the boxes would be best done with the help of the local bat group to really cover your back.

For anybody who(like me) is fascinated by bats, Essex Wildlife Trust have installed an infra red camera in a large bat box at one of their visitor centres and are live streaming the results. This particular roost is the subject of roost counts which have exceeded 1,700 individuals in recent years. Went to the funeral yesterday of a pit boss who I worked with at The Sportsman casino in the 90s. This was played at the end of the service(he was a lifelong Chelsea fan) and as it started smiles of recognition appeared on the faces of those of us of a certain age. Rest in peace, Mike.
