  1. Not really a problem mate, it just means we are already getting a great deal, so there is no profit left to trim when the shows come round. I still buy my saws from the same dealer I have been buying from for 20years, I first went to him 35 years ago at the age of 10 with my dad. The internet has allowed me to haggle a good price off him, so I get all the advantages of a local dealer, but at a great price Obviously I'm lucky to have such a good local dealer (Dick Leigh) many do not have a good local dealer or their dealer refuses to come close to the web prices, in which case buying off the web is best for them.

So are you saying that if your neighbours tree over hangs your land to such an extent that cutting back to boundary will badly damage damage the tree, you can't cut back to boundary??, surly its not "reasonable" to expect your neighbour to put up with effectively losing usable land for the sake of someone else's tree??? As for BS3998, the very fact that you can only lawfully cut to boundary means theres no chance of working to BS, unless the owner see sense and allows you to cut beyond boundary where required.
  3. Totally agree, the neighbour is way out of order, as is the contractor who carried out the work. But with our legal system your clients chances of getting justice are pretty slim, IMO. If your client has loads of money and are of a mind set that can handle hassle, then they could go for it and I wish them the very best and hope they take their neighbour to the cleaners. But you can waste a whole heap of money and a great deal of your life on these things. If it were me I would get the neighbour to pay for the trees removal and replacement, with the threat of action if they refuse.

You have just listed all the reasons a "no win, no fee" Co would not touch it with a barge pole I really don't think arb law is complex at all, I've been doing tree work full time for 18 years, cutting 1000's of trees back to boundary and never had any problems. I really think you have made it out to be far more complicated than it is.
  5. I agree. I believe in France you even own your view and if some one wishes to block it they must buy the view off you.
  6. The "nuisance" is not "shade", its taking the airspace of another, why should anyone have the right to steal a neighbours airspace??????? In this country "shade" is not a legal "nuisance", as far as I'm aware you have little or no right to light, in order for it to qualify as "nuisance" you would need to be in such darkness as to need your lights on all the time.
  7. Yes it is, on the job I mentioned earlier I climbed the tree from my customers side of the fence (threw a rope) I roped into a limb right on the boundary. But, TBH trespass is a pretty minor offence and if you were doing it to "abate a nuisance" I don't think you would face much in the way of penalty.

But if the branches had been thrown over the owner would have had more stress, depression, etc. I agree with you if the branches were not overhanging the cutters land, but if the branches are overhanging, the cutter is within their lawful rights to cut them to boundary, so I don't see how failure to return the arisings can lead to any offence other than theft???
  13. Yes I asked the neighbours daughter, in front of the police if they wanted the branches, they did not. Do you have an example of compensation being paid for "theft of branches" as I have heard throwing the branches onto the tree owners land can be seen as "un neighbourly" I don't see how branches being stolen can then lead to an offence relating to the "amenity value" of the tree????????? If I build a very beautiful extension on my home, but it overhangs my neighbours land, what right do I have to effectively steal my neighbours air space?????? PS, I told the police officer the law, I did not ask, he got a bit shirty and said "I know the law!!!":biggrin:
  14. Surely thats only if the branches are not over hanging other peoples land. You do not have the right to impose your branches on others (TPO not withstanding) I had one a few months back, neighbour agreed to overhanging branches being cut back, we arrive to do the job, customer and neighbour have fallen out, neighbours daughter and friends tell me cannot do the job. I point out we can, they make threats, I laugh and begin work, the police arrive, I point out the law, the police agree, we finish job and get paid, customers daughter pulls faces at us through the window

  16. Personally I think customers are more impressed if you don't use ladders, it makes them less likely to think they could do it themselves. I often get offered ladders by customers (as I never take them) I just smile and say "no its all done with ropes, ladders are far to dangerous for tree".
  17. Goes back way before that Tony, the first paddy fields in china (releasing methane), the first clearances. I heard quite I good argument on radio4, that without mans affect on the climate over the last 10000 years, we could have entered another serious ice age, that could have killed millions. TBH, I really don't think we are any where near knowing what affect if any we are having on climate and whats just normal cycles (if there even is such a thing) Really makes me laugh when we have flooding or a drought and people blame GW, but then say "this is the worst flood for 100 years" or "this is the hottest its been since records began" and you then realise records began 150 or at best 400 years ago, thats seconds ago in real terms.

  19. When I was a boy in the 70's my brother was terrified of nuclear war, I wonder how many hours he wasted worrying about it??? Best not to worry about things over which we have little or no control. Growing up I remember doom merchants, before the year 2000 we were going to run out of oil, the population would reach 10billion, etc,etc..............
  20. Not just governments. Religion was a real money spinner, but many have woken up the the reality of evolution etc, so "going green" is the new religion and many are using it to cash in
