Magpies in Hawthorn

Just turned up to a job for tomorrow and there is a magpie nest in the middle of hawthorns I have been asked to remove in a garden. Any issues? No eggs and owner reckons they have been building for a week.

Any help, need to start job tomorrow, no other nest in vicinity .

I would not like to say whether building a nest would be classed as using though

 

Yes it is, so you would be committing an offence if you disturb the nest.

 

Although there is nothing to stop you from shooting the Magpies, then the nest would not be in use and no offence would be committed.

Will have closer look tomorrow. Garden owner says he has seen magpies in tree but not sure if they are actually nesting. Ladder job to check. Seems unlikely they are as a demolish and rebuild within metres of the hawthorn. Mrs Landowner thought a nest as the birds had been in the tree this week😳🔮📢🍋

Thank you for all the help here folks. Managed to borrow a set of binocolours so will have a much better idea within an hour or so and with no disturbance to our feathered friends if they are in there. Lengths we go to for red tape in this country .🛂🚫😇

They are vermin and come under general licensing.

You are allowed to kill magpies under a "conserving wild birds" rule.

 

Im sure I saw them robbing the robins and blackbirds nest in nearby gardens didn't you??

 

If the nest hasn't been clay/mud lined in the bottom its only half built. Ive been watching a pair today actually building 2 separate nests at the same time which isn't uncommon in magpies.
