are hedges protected in a conservation area?

would a maintained Leyland cypress hedge be protected in a garden within a conservation area?. the stems are over 75mm dbh

 

I was under the impression that if the hedge forms part of a garden and has clearly been managed as a hedge it is not protected and should not therefore be subject to legislation as per trees within a conservation area

Had this conversation with our local tree officer laurel hedge in conservation area with 125mm + base and was told to proceed not a problem.

No it's not. I put an app in on one and was told I didn't need to.

As I understand it, if you are only trimming the hedge then no notification is needed.

 

If you are doing a height reduction of a few feet or more, or felling it, then notification should be made.

I would not submit a notice, the councils only option would be to TPO each tree, which I don't believe would be feasible for a maintained Leylandi hedge, IMO.

Yes, it is covered, email the tree officer of your intention, he will probably tell you to get on with it and not bother in future, but at least you will have a cover note for the future, it's best NOT to piss a tree officer off by ignoring the rules.

I have to deal with tree officers every day, it's very tedious BUT I'd rather have a good relationship with them than having them say no when it's a big job!

If you believe the trees are covered by being in the CA (which I don't feel they are) who ever dug the trench could be be in trouble.
