How do you go about collecting money from bad paying customers? im about to go the route of small claims court but unsure what it entails and if it costs me money?

Steve,

This is a problem for us all. I suggest you look at money claim on line, do a serach for it on the internet.

It is the website of her majestys court service, you can submit a claim on line, enter judgement etc.

Make sure you go through all 8 stages of the process and also make sure that you fill in the claimants details correctly, that is you, and the defendants details, your bad payer. Don,t get these mixed up or you will end up suing yourself. You have to pay by credit card and this can be added to the original claim value. If the customer still does not pay up you can enter judgment against them which puts them on a bad debtors list. If this fails you can also arrange on line to have the bailiffs sent round which is the process called a 'warrant of execution'.

I'm not doing a law degree for nothing as I have been 'bitten' too many times in the past.

If you want to chat about this ring me on my direct line 0191 2361023

Regards,

David O

We have recently had to use the new on line small claims system, it was quite easy. You can also log back in and track proceedings despite contacting the company a lot of times when they got a small claims summonds they paid immediately. It wasn't a lot of money but as you said earlier its the principal of the thing.

Another idea would be to arrive at debtors house with a truck full of chip and explaining that unless they pay, you will have to return their tree. Tipping the chip right behind their car & blocking the drive. This would probably work best on a monday morning just as they are due to leave for work!
