Fragile Tree on Border with neighbour

2 things.

The Access to Neighbouring Land Act only applies to England & Wales.

Court will only grant access if (among other things) it is satisfied "that they cannot be carried out, or would be substantially more difficult to carry out, without entry" to the neighbour's land.

 

In theory if an accident happened or damage was done that could have been avoided by obtaining a court order for access, there might be repercussions.

 

Either way, don't delay.

The tree surgeon has made another visit - and will be able to remove the tree with difficulty by cutting it in small sections and then passing it down to his assistants  - the job is going to cost more than expected.It is likely the surrounding flower beds will be trampled but they can be replanted in time.

 

If this could not be done then a court order would have been my only option.

I think I’ve got the same picture in my head as everyone else of the ‘Tree Surgeon’ passing sections down to his ‘assistants’.

They cant cut it at the base and hope for the best. so its going to be 4x as much money
