  3. Like Ted says, the "day of the screen" is creeping up on us... It starts with the pay @ the pump for fuel, now McDonalds are going large with it (although I'd rather deal with a screen than a pimply youth shouting can I take your order when I'm clearly still looking at the bloody menu board). Then there are those really user friendly self serve tills @ the supermarket. I can see the ever increasing minimum / living wage leading to greater automation.

  5. I have a similar problem painting 2nd story gable end which is above a ground floor conservatory. I was thinking of a scaffold tower with a board across to the apex of the roof as poorly illustrated below.

Hey Eddy, valid points above and noting that we're stepping into assumptions and theories (notwithstanding those that have actually seen the tree) but if the report (as it has been represented) doesn't actually record the full nature and extent of the current 'structural defects' then the motive for recommendation of 12 monthly inspections could be questionable since there is no benchmark against which to measure potential deterioration and provide data for an informed decision on retention / management options / future removal. Pure speculation of course, but (as represented) it could just as easily be interpreted as: cut & paste a few key phrases into a report in order to make it look 'the business,' or, justifying an annual income stream of repeat inspections, or as placing an 'end date' on the validity of the current report. As I say, pure speculation but interesting to see how it develops.

  10. You say "a curious phone call" Gary, and it does seem curious from what's been described so far. If I put myself in the householders' position, I would probably have called a builder / civil engineer given the circumstances you describe. Did they say what caused them to call a tree guy? Do they maybe know more than they are letting on or have they preformed a conclusion that it's a root problem? It does seem curious.

Debated but not resolved perhaps? And that would certainly reenforce the view of the TO I recently had a conversation with which was something like.... "...I wish this scenario would finally go to the High Court and give us some clarity on interpretation...." I'm looking at Mynors 23.6.5, and thinking back to the recent seminar at Barchams. And noting your closing comment on the thread "...This aspect that Gary raised about the distinction between encroachment, nuisance and actionable nuisance is as you suggest unpredictable in the average situation. I am torn, as I always have been..." And your suggestion "... it's a matter of degree..." Then I'm left thinking the same as the TO I mentioned above! Since I've got one just like this potentially coming up at the end of the month I'll see how it plays out. Mindful of what others said in that thread about lost time, additional hassle & admin associated with such scenarios though, I think it'll only be taken forward as a price for the tree work and any additional / associated administrative arrangements at an hourly rate.

  15. It is just an observation Chris. The offices are cheek by jowl - it's a matter of fact. Wether that has any significant contribution to lobbying, Insidious nepotism and self interested cronyism, or that it is simply efficient placement of office real estate so as to facilitate communication and working relationships - now that's a matter of personal opinion!! 😜

A little bit off tack, but an example of such assumed / implied "authority" which might not actually exist could be the LA requiring a TPO application from a person wishing to cut back their neighbour's TPO'd tree as far as the boundary. I've found that in such circumstances the (as yet informal advice) from LA is that the non tree owner should apply via TPO route. It seems illogical since it's the abatement of nuisance that the person wishing to cut back is undertaking and as such, they need neither the tree owner nor the LA approval / consent to do. (Question rather than statement!) I only put the question in continuation of Gary's / Treequip's observations on "assumed" authority by LA, maybe if it takes off I'll move it over to a new thread if necessary?

  19. Notwithstanding the formatting issues of transferring it into the forum....... If that is the full extent and all the content of the report..... Whoever paid for it deserves a refund.

Someone will probably confirm or otherwise, but I'd think, unless the parish council is the tree owner (which would only give them ability to consent if approved) they are simply a consultee rather than being in an executive decision making position in either CA or TPO scenario. Looking forward to the pics to follow!:thumbup:
