  1. My monies is on the first 6 month winter for 20 years and the cold snap in May. Also when the trees are near a highway a combo of the above with rock salt will be having a negative impact upon the trees. I would give the trees a little more time to recovery from this factors and considered that most trees species are 4 weeks behind from last year. This reminds me of a site visit last year in July with a landscape architect. I was asked how did I know that one of the trees on site was dead? I ask back is there anything green on it? I got the reply back of No! I than asked what month it was and then penny finally dropped:sneaky2:

  3. I my humble opinion a defect lead policy is not where the industry should end up. It has to be all about the target area, there are very few if any reasonable reasons to manage a tree that target ares is occupied by one man and a dog once every year five years. I also hold the opinion that an appropriate inspection regime should also be determined by how large a land owner is and what resource they have or should have at their disposal. I to have not had time to read the document, does anyone know what it says about S 154 of the Highways Act (1980)? Has this document suggest new legislation for tree safety bring together the above Misc. Pro. 1974, Occ. Lia. 1957 and 1984?
  4. No you can not insists that the owner of the tree take the arising from pruning the tree. Also were you to throw it over the boundary and by doing so you caused damage you or your insure will be picking up the bill for the damages.
  5. If the tree is dead, dying or dangerous there is no need to revoke the TPO. The TO could give consent to fell and replace the tree via an application or advise the owner or agent that it is within the statutory exemption in S198 SS 6a of the Town and Country Planning Act.
  6. Sorry guys it is Local Government (Miscellaneous Provisions) Act 1976. Not all Councils are willing to use this Act but I have severed these in the past for a Council at the request of a local councillor. Also some times on new developments planning conditions and covenants might have to be considered both any works are carried out. However enforcement of a covenat is very rare and can only be done by the rights holder. Often on new developments it is the managing agent and they are usual not interested in enforcement and the complaints end up with a Council Officer:thumbdown:
  7. When the LPA has granted consent to a tree works application there is no right of appeal to the planning inspector. You could make your concerns to the local Councillor, make a complaint via the Councils in house procedure or go to the local authority ombudsman.
  8. AC, I was thinking the same but could not found the polite words to express it:lol: READ the SCOPE of NHBC Chapter 4.2 it is not a manual for predicting heave. Also this document is hugely flawed it allows you to reduce the depth of trench foundations 30cm by going north from the south east of England. This does not take into account the alluvial soils around Hull! I known that lots of Arbs think that they are experts on structural damage and how to repair it. But the Courts do not share their opinion! The diagnose of subsidence and the prediction of heave SHOULD be undertaken by a STRUCTURAL ENGINEER! The Institution of Structural Engineers
  9. I recognise the 2.5cm as the Alan Mitchell method for calculating the age of trees. I did a search on this found the following page; BTCV Handbooks Online Hope that helps. There are also cultural methods to estimate the age of trees i.e. old maps, aerial photographs, place names etc.

  12. If you want to check the colour of fungus spores you have to leave the fruiting body on a piece of white paper or on clear plastic over night. If you want an identification on fungus then I think that the Tree Help still carryout this service:confused1: Tree Help.info I have been known to go fungus picking the spore test can be very useful in avoiding death:lol:

  14. Hi, I would get in contact with your local FC Forest Officer for free advise and have a look at the wood-net website. WoodLots You ever know that might be some grant money available if you get an application in at the start of the financial year I also recommends the following book and booklet; The silviculture and management of coppice woodlands http://www.forestry.gov.uk/pdf/so-you-own-a-woodland.pdf/$FILE/so-you-own-a-woodland.pdf I would then sit down and write a management plan, examples at the bottom of the following page; Forestry Commission - Woodland Planning Grant Good luck and have fun.
  15. I have an old blue book from 1997, forestry degree and have been a TO but only started SRT climbing this year. But thanks to many years of inspecting quality tree works and butchering. I think, I might have more than an idea how to prune a tree so that it looks aesthetically pleasing and it is still a variable biological organisms.

Evening all, the below link will allow all of you to see the conference notes from the speakers; ROYAL AGRICULTURAL SOCIETY OF ENGLAND EVENTS - CONFERENCES - TREES DISEASES CONFERENCE It was a very good conference, one of the main points was how to control biological risk between different sites. How many of us remember to clean blades between sites and who if anyone cleans their boots or the wheels of their vehicles before going of to the next site. Also for those who have not heard Phytophthora ramorum (sudden oak death) was found in a stand of larch in the south west in 2009. Evening All, I was trying to find the 'Blue Book' on line but came across the following document; http://www.planning-inspectorate.gov.uk/pins/advice_for_insp/tree_preservation_ct14.pdf I suggest reading section 5 and 48. In my humble opinion woodlands should protected within the Forestry Commission grant scheme be it Wales, England or Scotland. I have only ever severed Woodland Orders as a last resort. This is due to them being wrongly severed on domestic gardens when someone was not ass to count all the trees to place them in a group order.

  22. I have seen him in the past, I think it was in 2005 at Capel? I would like to go and see him again but at £165 + VAT, IMHO, it is not good value for money. Given it is only £60 for RFS members to attended their Tree Diseases Conference this year.   23. Hi, once you send in your S.211 notice the LPA has 6 weeks to week an object to your proposed weeks be protecting the tree within a new TPO. The guide can be down loaded from the community and local governmentat website; Protected trees: a guide to tree preservation procedures - Planning, building and the environment - Communities and Local Government With CA notice a LPA cannot vary the notice so if they do not agree to the felling they will place a TPO on it. So it might be a very good idea to try and get the TO to site before submitting the notice.
