  1. IF you have a BE prior to 19-01-2013 then the trailer can be any weight.
  2. Dont tow in the snow. So far this week I have lost 3.5 days driver training (mix of trailer & learners). 3 trailer tests cancelled by the DVSA (which was the right call) & a days firewood processing on Sat. Not a good week. Fully booked up for about 6 weeks so I will be pushed to get them back in asap.

  4. You seem to be miss understanding what I am saying. People are making claims that garages will stop you removing the car, give you a ticket or fail under the dangerous to make you get the work done there. Non of that is true. Yes they are changing the contents of the test. But the law has not changed re the legality of driving a car pre or post test.
  5. But thats the thing the rules are not changing. They are testing new things, they are recording the faults in a different way. But the law was & still is that it was illegal to drive it if it did not meet the basic safety standards ie it was dangerous. People read that you can drive to & from an mot test with no valid mot & think that applies to it no matter how shitty or dangerous the car is. This just makes it much clearer that you cant drive it if it is dangerous. So less people should get caught out.
  6. I actually missed it was a pass. But again that has nothing to do with the changes that are coming. PS lots of things are not in the test or can't be tested due to no access but can be dangerous.
  7. Since when does a garage issue tickets? There has be NO change in the law. There has been a change how you will be informed of the condition of your vehicle. That's all. It has always been illegal to drive a vehicle either to or from an mot or with an mot IF it is dangerous. Up till now it has been easy to claim that you did not know it was dangerous. Now with the new method even a fool can't claim that. You could fail an mot for a rear seat belt but it would still be safe to drive with no rear passengers. But if like yours it failed for a fucked tyre it should not be on the road even if it does have a valid mot.
  8. Garages have NO powers to stop you driving a dangerous car. They might try it on or call the police (but that would soon kill there business). You drove it there just as illegally as you do taking it away.
  9. Not sure where the reply I made yesterday went. Explain what? The car failed its mot with a dangerous fault & you drove it home illegally. Just the same as will happen under the new method.
  10. 1, Old or new rules a garage can not stop you removing your car. 2, New or old rules that has always been true.

  14. You can be fined up to £2,500, be banned from driving and get 3 penalty points for driving a vehicle in a dangerous condition.
  15. THIS BIT In both cases, your vehicle still needs to meet the minimum standards of roadworthiness at all times or you can be fined.
  16. No & you never have been allowed to. It was just that people thought you could as the lack of an MOT was not a legal issue going to or from the test. However you still had to comply with C&U & the vehicle be safe.
  17. I was replying re the not being allowed to remove your car not the full changes. PS Engine management lights can be a safety issue as the car can suddenly go into limp mode. You do not want that to happen on the mway. Thats why the light comes on at the first sign of an issue.
  18. There is no legal change. Its now just clearer that you should not drive a dangerous vehicle. The garage have no right to stop you removing your car however you like. Some might claim they can. It has always been that it would be illegal to drive a dangerous vehicle home. Yes you could drive it home but thats an MOT exemption not a get out of jail free card for driving a dangerous vehicle.

    Yes but that was not your claim. You claim was to de rate a larger vehicle MAM to 3500kg, Keep the higher rear axle loading to take the trailer weight even if that put the total vehicles weight over 3500kg. Not sure how you can get a 6 tonne load on a trailer plated to 3500kg as that would be an applied load of at least 3 tonnes due to the trailers actual weight too. Or they hold pre 97 BE, still need active brakes but can have a lower applied load. Not enough detail in your post to comment on specifics. Or are you running air or elec brakes?

    Donnk, Read this link. http://www.transportoffice.gov.uk/crt/repository/CONT067324.pdf Any weight transferred to the vehicle by the trailer is an applied load so counts as vehicle weight. It is not magically lost.

    The only people that can tow a trailer plated to 5000kg are pre 19-01-2013 BE holders or C1E (without 107 restriction so no pre 01-01-1997 licences unless they took the test) or CE holders.

    Why does the plated weight have to be 5000kg? With a 5th wheel trailer 3500kg plated vehicle 3500kg plated trailer vehicle actually weighs 2000kg inc fuel & driver so is allowed 1500kg load. Trailer actually weighs 1500kg so is allowed 2000kg load. Total load on trailer 3500kg

    Sorry crossed wires here. On a pre 2013 the plate can have any weight. The nose won't be weighed but if its over the axle would be over too. for licences using plate or doc weights Pre 2013 vehicle plated up to 3500kg. Trailer any plate Post 2013 vehicle plated up to 3500 and trailer plated up to 3500. For c& u using real weight No axle can be over its limit No vehicle (car of trailer) can be over its mam/ mlpm No combination can be over the GTW / gcw
