Working without certificates etc

As a contractor I broke my leg badly on an FC site years ago, the forester we had in those days was a real bash on get the timber to the roadside kind of chap.. Kind of person that is badly missed these days. Anyway first thing he said was "don't tell the f@cking hospital what really happened or we'll all be up to eyes in paperwork and reports" !

 

I stabbed myself last weekend, right in deep, left palm in the muscle below the thumb on a 2" thorn. Hurt like a bar steward and hand had seized up by the end of the climbing task. Made things a bit tricky towards the end.

 

Went into minor injuries in work gear on way home just in case and they asked if it was a work injury.

 

In truth, I don't think it was, it was whilst having an emergency bush dump before starting.....

 

Point taken though, ED ain't gonna police it. We had a builder fall off our roof and be evac'd by air ambulance. It was always going to end up with a serious incident, his working practice was atrocious. No HSE investigation.

Beginning to look convincing. What sections of the aforementioned do you think apply? I ask because I bet the wording is vague and it all comes down to common law and common sense anyway.

no comment, as everyone is to blind to realise the difference between lawfull and legal, you can sort it out yourselves, just remember the wonderfull phrase"governed by consent"

 

 

There is no difference between lawful and legal, they have the same meaning!

I googled this out of interest, can't say below is accurate...

 

Lawful and Legal are 2 totally different things.

 

Lawful/Law is Common Law (some call it Gods Law). The primary principle being one should not cause Lose, Harm or Injury.

 

Acts/Statutes are created by Parliament or local authorities, they however ARE NOT law. Acts and Statues

the new emergency woodland and hedgerow dump regulations 2014 states " if you bowels give you a 5 minute warning or greater, then you should carry out a site specific risk assessment". However if you have a 1 minute warning or less then the regualtions , like you sphincter at the time, are more relaxed. :001_tongue:

+1 on Lawful and Legal. Legal is made by statute.

 

"Is there a contract?", is the big question here. If someone has requested someone else to do something and money or 'monies worth' changes hands, then a contract has been formed. And you can't contract illegially. IE, outside the law.

 

If it was my land, then within reason, I can do whatever I want. The issue is are my actions causing harm to anyone else or causing someone to suffer loss? If not....

 

Dangerous and 'illegal' are not the same thing so just because someone is wearing wellies is of no issue. You can't fix stupid.

 

I got called to a neighbours a while back because a silver birch had fallen across a paddock fence and she wanted 'someone proper' to get involved. On the other side of the field, was a bloke who was mixing the 2 stroke with the petrol in the saw, no helmet, no boots, his wife and kids were carrying away the wood, dogs running 'round - all with the owners blessing. What can you do?
