Enviro agency scum.

 

Basically they sit on there fat lazy arse watching us work our arse off then try to slap fines on us every time they can.

 

The point about it only being 150 for 3 years is a joke the point is why should we pay it we been fine all these years without one.

 

I hope this country crushes itself to death and gets taken over by immigrants. oh silly me they are. :thumbdown:

What really pee's me off is if I had been a member of Arbtalk or been someone that keeps myself to myself I'd have never heard of a waste carriers license until I was pulled and fined.

 

They cannot possibly prosecute unless they have written or given notice to someone, or they can prove that that person knew of the license, Surely

 

You should have gone to college and trained then thats where I was told about it :001_tongue:

 

Only jk, theres probably loads of other stuff we are supposed to do/have to comply with every single bleedin law :thumbdown:

 

We already have a license so It dont matter to me and I think it is a good thing ONLY when they start pulling EVERY1 over and ask to see the license then promptly fine them. Otherewise I'm paying £100 a year for absolutly nowt.

Ignorance is no defence in law. This is the thing with the fixed penalty notice, and why they are becoming more common. Whoever stops you has the power to criminalise you there and then, at the stroke of a pen, and it's a lot cheaper and quicker for them than bringing cases to the courts.

 

I wouldn't call it ignorance, that's a bit sharp, just because people don't use forums and read Arb mags doesn't make them ignorant.

 

Some people I talk to have never heard of it and I do think it would be difficult to fine someone in court because they have never been made aware. God, even people who DO know about it are confused.

 

I would not accept a fixed penalty notice for something I have never heard or been made aware of and would be more than happy to become a test case. Although I would find it hard now arguing that I have never heard of it :001_smile:

Had a long Chat with the Environment agency today. In fact, I'm doing quite a bit with them at the moment, and one of the things that came out was

a. waste carriers licence

b. Registration for exemption

 

Firstly, under new rules, ALL of us need waste carriers licences. No excuses, no loopholes, you HAVE to have it. No good saying its a product blah blah.etc.

 

secondly, if you take tree waste back to your yard, you need a paragraph 21 exemption certificate for processing controlled waste - details below.

As I'm given to understand, none of this is optional - by law you need it.

The first is £148, the exemption is free.

 

Be interested to know if you know anything about this.

yes I know its more nanny state bollocks, so no posts whinging about it. but can anyone put forward any case law or similar that disproves what they're saying?

 

I knew all the above yonks ago, i've had a waste carriers licence for years, lets hope your post Ed clears this matter up once and for all!
