It strikes me this is the only reasonable option

 

1 the clock is already ticking

 

2 the TO wants it preserved but it is not of good form, though it may have public amentity

 

3 it's a liability and the owner will already have to demolish the wall for safety reasons as it's already 15 degrees out of true.

 

4 the TO will have to justify making the TPO and it will cost the council to serve it, will it go to planning committee or under delegated powers?

 

5 the owner then has 6 weeks to appeal and PINS gets involved

 

So the council have to decide is it worth the cost and the owner has to decide can he afford the appeal procedure.

I didn’t mean to imply that withdrawal of the notice was ‘a preferred course of action’ but merely that it is 1 option.

 

Seeking or discussing the reasons why the request to withdraw it was made might be a first step in understanding how things might progress to mutual satisfaction. 

 

I know, an uncharacteristicly mellow suggestion which may, at first glance seem submissive, but jaw-jaw an all that. 

 

Normal service will be resumed shortly - I’m trying to maintain a (relatively) mellow January. Although I failed spectacularly with an epic, no holds barred, all guns blazing (wholly justified multiple expletive) rear up with the sparky re-fitting the solar panels today.

Hmmm, not sure "D.D.D" can apply here...plus since 2012 TPO Regs changes it's only D.D...but 'dangerous' still covered, assuming that's what you're referring to (if so the 'danger,' a possibility, is indirect, i.e. displacing the wall to make it unstable, and not in relation to the tree condition itself, i.e. failure (unless you think the union is likely / probable to fail.))

Not too late to plant still, maybe get a replacement in now as a demonstration / commitment to continuous tree presence at the site...may come in useful later on, i.e. at appeal (if it goes that way) :I
