need help with customer..refuses to pay.

I have been in this situation many times over the last 25 years and been to small claims court 4 times and won judgment each time but only been paid once.

 

The first thing you need to asceratin is, if you took them to court and won, do they own anything?.

 

Your quote is your main legal back up if you do decide to go for CCJ.

 

Some times people will back down, some times they are bare faced liars who will drag things out hoping you will give up, only you can make the judgement but certainly try to be polite but forcefull in the begginning.

 

Personally I would consider taking the money offerred then pursue the balance but of course this depends on your own financial situation.

 

Accepting the lesser value does still leave you free to pursue the balance as per D&C Builders Ltd v Rees, ie preventing the debtor extracting an advantage by economic duress, namely you needing the money they offer in order to maintain the security of your business.

I hear what everyone else is saying. I think salt on the flower beds and weedkiller etc is not an option IMO - why? because you will not get any money and with so many cameras around could get in trouble re criminal damage - then you're doubly stuffed and your reputation is gone.

 

I've only had it once. Send a copy of the quote with a letter saying that they have 7 days to pay or you will take to small claims court. After 7 days you can then have them sent a summons where they have to justify why they are not paying (will cost £25-00).

 

If they don't reply and don't turn up then the judge will rule in your favour - but you still may have trouble getting the money.

 

Never tried the debt collector route but that may be another option.....

 

Or take the £260-00 and put it down to experience... that's what I'd do these days... sad really :thumbdown:
