Is this is ridiculously over the top? £20,000 court bill after Elsenham tree surgeon admits burning waste AN Elsenham tree surgeon and his business have been ordered to pay almost £20,000 for burning wood chippings and green waste unlawfully on rented land. Today (Tuesday, January 14), 39-year-old Max Barton, of Elsenham Nursery, Stansted Road, and FR Barton & Son Ltd, of The Street, Little Dunmow, pleaded guilty to contravening environment regulations at Home Farm, Gaunts End, between July 6 and November 30, 2011.

  10. I am afraid it will end there Chris or at least for the time being. I have given my client several alternatives but it looks like the tree will become TPO 'd and the trip hazard will remain which is not good practice.

A major lateral root is lifting a path and creating a trip hazard, this needs to be addressed for obvious reasons and the only way to do this is dig up the path, remove the root and relay the path. If the work isn't done the trip hazard will become more prolific and quite possibly with today's blame culture my client will be on the wrong end of a court case. One of the objectors has actually said 'why don't they just remove the root and leave the tree', the tree is immediately adjacent to the path. Photo's of the problem were supplied with the 211. There have also been other issues with the tree over recent years.

  13. I am sure many people are waiting to see a few pic's, it sounds like a great idea to me, so many of my lads walk around with the family jewels hanging out at times. Chainsaw trousers are not the easiest to repair so good luck to you.

  15. They have called this morning to say the price has dropped and do we still want to proceed with the loads we have booked for tomorrow. It looks like the end. We will continue with tomorrows loads but I think it will be the last we send unless the price goes back up. Trouble is what do you do with an artic load per week?.

Without going into to much detail, the tree is causing damage to property and in order to rectify this the tree will need work carrying out which in turn will lead to the ultimate demise of the tree. Locals have objected to the removal which they have a right to do but their reasons in the main are not valid and they are simply 'clutching at staws'. The LPA would like a replacement tree and I personally think this is reasonable but obviuosly they cannot insist on this, my client does not want another tree and therefore I believe the making of the TPO is no more than an attempt to get a new tree.

  18. Well I am sure you know where I am coming from on this one and therefore have strong beliefs. However, a good lawyer and magistrate who is in touch with reality can often shine through so to the guy who started all this, good luck.

I have never known that as planning conditions are normally envoked by the planning dept which is often seperate from the tree officer, I am not saying it can't happen but I have never been given that info when enquiring unless we ask and we deal with a lot of different LPA's. Just goes to show I guess.
  20. If the LPA decide to put a TPO on a tree you have applied to fell within a C/A then they serve you with the TPO, you then have a right to appeal. So if you decide to appeal and win you can then fell the tree, does this mean you don't have to bother to replant as per the 211 or do you have to replant because they did in fact TPO the tree?. Hope that makes sense.
  21. Interestingly, if you phone or e mail for a TPO or C/A check a planning condition will not show unless you specifically ask.

And generally speaking with regard to trees isn't worth the paper it is written on, not being awkward or looking for a fight but have you ever heard anyone be prosecuted for felling trees that are not worth a TPO, if they were of any real value they would be protected propertly with a TPO. I will stand corrected Chris.

  24. Hodge, when you chip into the chip box with the tipper up, doesn't it make you cringe when you drop the body back down and it goes with a 'smack'?.
