  1. haha Went to price a job this morning. Guy tells me he wants 5 trees in a plot next door felling into the plot and leaving. This plot is obviously overun with bramble etc and not been touched for years. He tells me he has his neighbours permission to carry out the works and non of the said trees have tpo's, he even went on to point out the trees which do have tpo's. No problem I said, I can do that for you. But what I would advise is for you to ask your neighbour just to scribble on a bit of paper that he gives his permission for you to fell his trees, to cover yourself and me. This would be my normal course of action, with no influence from this thread The neighbour was not contactable as the house next door was in a state of disrepair and had not been lived in for years. Each case can be completely different, not everything is as black and white as "just go ask the neighbour"

  9. There were two spare nuts in the sack Robert, so I gave them to our lass She was on about taking them out of the sack and displaying them on the mantle piece

I think this is a difficult one If we are going by land registry, then any trees near a border, even if they were within the customer fence, might still not be his What I am trying to say is how the hell can we prove tree ownership there will be cases as in my woodland edge example where everything isn't quite as simple as asking the neighbour I can honestly say I have never had a serious problem because I have always done just as been said, I go next door and inform them of intended works, which is in effect their opportunity to express any concerns.

  14. I did a job last month Prune back trees at the bottom of a garden at the edge of a woodland. I asked who owned the trees as they were over the otherside of a 1 foot high border wall. The guy assured me his boundary was halfway down a small slope just into the woodland. Who owned the trees beyond I asked. YEB he replied Now I have established he owns the trees, do I spend a day phoning switchboard wallers putting me through to this dept and that dept to establish whether or not I think the guy is a liar Or do I take his word for it, (no reason to doubt) Then, and here is what I am trying to establish Would I have been prosecuted for not knowing the facts or him be prosecuted for knowing he didn't own the trees and misleading me

  16. Believe it or not I am not arguing, I'm trying to find out facts, I'm as keen as anyone to know where we stand. I fail to see how WE can be held responsible provided we have taken steps to establish tree ownership. According to what we have established so far peices of paper with things written on are not worth the paper they are written on.
  17. No you dont take their word for it re tpo, you check without their knowledge because you can do so. You do not question them to their face and tell them you cannot trust them so you'll have to check yourself. My argument is not about TPO it is about tree ownership and whether it is the tree cutters responsibility to double check and if the tree cutter asks the questions whether he is still liable and not the tree owner

  19. Its not my tree Andy, I'm just trying to establish hard fact from speculation
  20. It is within my remit to enquire on a tpo , most customers dont even know what a tpo is, they do however know whether or not they own their tree. I have no easy way of finding out whether they do or not. I do not have a data base of tree ownership to fall back on, I do have a database of tpo registrations to refer to.

First of all it will be difficult to prove you had doubt and it would be a case, not of, "I thought it was his tree" but a case of, "I asked two or three times if it was his tree and he catagorically said it was" We have enough on our plate without the duty of deciding whether or not the owner of a tree is infact the owner of the tree

  24. I'm going to get a chrome plated torque wrench for my chrome plated nuts Peter, I will do a google search tomorrow for specific torque settings
