  1. Try it and see. In my experience people find it easier to envisage 2m (or 6ft for example) off the outermost parts of the tree than a vague "20%". I think its easier to work to as well. I.e., just get up there and take 2m of every bit!! Done. The cut diameter bit shuts up those people who for some reason assume that you're going to hack large limbs off at the main union to achieve your goals.
  2. Why not specify in terms of dimensions??? "Crown reduce by the removal of the outermost 4m of the leaf bearing canopy back to suitable secondary growth points. Ensuring a flowing branch line and a natural crown habit for the species. Resulting pruning cuts will not exceed 100mm in diameter." Just specify the confusion away...

  9. What you'll want is an unlocked form tabbed .pdf copy of the tree1app. The ones off the PP are locked though...
  10. It's possible... After completing the planning portal online form there s an option to print off a paper copy - this in fact allows you to save your form as a .pdf... You could then email that.

  14. If it dies, the TPO still applies as that space is still reserved for a tree, the LPA can serve a Tree Replacement Order to enforce replanting. There doesn't need to be a tree for there to be a TPO, its a charge on the land. The exemption simply refers to the need to apply for consent.

  17. I'd be surprised if the form your council has been using up to this point was exactly the same as the new one. The first few pages are largely the same but it is completely different towards the end of the document. Notice that you only have to submit one copy now with new form! One version of the old 1App I saw asked for 3 copies plus the original!!!

  20. Thanks for the addition clarification Chris and the links. Though I would defend my use of the word 'or' in the first instance as many would not technically consider the online application process a 'form' per se. The issue of discretion mentioned previously by myself relates to the insistance of evidence in the second instance and not in reference to 1APP itself.
  21. Alrighty then. New 2008 Tree Regs come into force tomorrow (01.10.08). Basic implications of which are:- TPO applications must be made on the lovely 1APP form or via the planning portal website. All other methods of application are invalid. (S211 notifications for cons area trees remain unaffected). If you are undertaking work for the reasons of Health and Safety (i.e., fears that part of the tree might fall or break) or Subsidence you must provide evidence to support your claims from a relevant professional. Appeals will be conducted using only the infromation supplied at the time of application. I have attached the addendum to the Blue Book (The TPO Guide to Good Practice) that reflects these changes. Those of you being told that you must use the 1APP form for everything take note!! Its there in black and white (in Blue!) I have also attached the new 1APP tree work form Get used to it. It ain't that bad once you do. Notice that its changed from the last incarnation. The last incarnation will not be the correct form and will be invalid. I have also attached the guidance notes to help you fill out the form. Its going to take most LPAs a few weeks to work out how to implement these changes so expect some differences in how you are dealt with. The key is for you to get up to speed as well. It may be that if you are the only contractor in the area that can actually get his applications accepted you might be on a winner!! There are mentions in there about the LPA's right to waive the supporting evidence requirement. We'll see how they pan out.
