Deviation from tpo permission.

Strange 1 this week,

Ash tree about 30 years old between a listed building and a restraunt, the owner asked me to price and apply to remove the tree as it's branches are starting to affect the roofs of both property's and block out a lot of light from 2 of the few window at that side of the listed building.

Applications approved by council.

Owner now wants me to prune and reduce the tree to clear the properties - for now.

 

Question is, if in summer when it leafs up again they decide it's still a nuance can we still go ahead and remove it altogether as per the original job spec.

Ow and cost of doing this isn't a problem to them as already discussed this.

As I understand it the permission is good for 2 years. A prune wouldn't be a problem as technically you're only part way through the granted dismantle.

Technically you haven't done what you've applied for so you can't, but realistically I can't see anybody being to worried. As already stated you have a time limit to carry out the original works

Check condition for how long you have to do the works. Then finish the job.

Yup, your prune would be the first stage of the dismantle, albeit with immaculate cuts.

 

Let's face it. Any TO who granted permission for a fell would be happy to give it a chance first unless the tree is shagged.

You could say you are doing it in stages to minimise the effects of heave due to the close proximity of the buildings .

So you prune the tree, and then two years later the permission has expired. Now the preserved tree is in a state/condition for which permission was never granted?

What then?
