What to do if an employer won't pay?

Hi All,

I have been working as a self-employed groundie for various tree surgeons for several years, and this is the first time I have encountered this problem. A guy I have done a couple of days' work for is refusing to pay me for spurious reasons. Does anyone have any tips on what my practical options are.

I live in Scotland, so possibly the details of how small claims courts etc work could be different from in England.

Any advise much appreciated.

If he employs casual labour and you know any of them make sure they know he is reluctant to cough up.

Firstly, don't do anything extreme or rash.Invoice giving a reasonable time to pay sent Royal Mail signed for, include the information that your next move will be Small Claims Court which, assuming you are successful, gets you your money and them a CCJ. If they tend to sail close to the wind with cash flow, the implications to their credit rating of a CCJ should see them paying up if they are in the wrong.

Sorry, but that's not quite correct.

CCJ only kicks in if culprit fails to pay within the time frame stipulated - usually 30 days(?)

True, I agree with the MCOL route because chances are this won't be a first offence so to speak, the fact it goes to CC word gets round and life becomes more difficult for ****s like that. Rightly so.
