TPO tree taken down with out consent

Hi

 

A few weeks ago I was asked to quote to remove 2 cherry trees in a front garden. The lady about 65 years old said that she had checked and they where not protected not thinking that she would have me over I didn't think to check for myself. It turns out that they where protected. The council now know that they have been taken down. What is the likely out come?

They where both on the way out with 1/2 the crown of each tree dead. But I have no way of proving this.

If like most councils at the present moment who are so skint they cant afford to put dog fouling signs up then they wont have two pennies to chase it through the courts if you are LUCKY.....................................

 

Tip for the future ,,,,,always take a picture of every job .

It is a wake up call for everyone, don't get complacent. Hope you get sorted out.

Totally agree ,a phone call and a E-Mail does the trick with a copy from Tree officer .

If you can prove they were almost dead it would not be in the public interest to prosecute as the council would have given consent to fell anyway. Try Google street scene if you are lucky you may get some recent summer pics showing poor condition.

 

Its still technically a contravention but you may get away with a slap on the wrist. The council can't prosecute for the sake of it, it has to be in the public interest. Offer to fund some replant, its better than a criminal record.
