VOSA landy and tacho

that defo works, just phoned my local vosa person,

and if you only work in a 50km radis from your base (as the crow flies), carry only tools to be used that day. And driving isnt your main job

 

you need a operators lisence if you have a van, but if you use a dual purpose vehicle ( ie 4x4) you dont need o lisence

 

O licence requirements aren’t based on body type, They are based on gross vehicle weight.

I dont think this legislation serves any purpose at all. It makes it more difficult for a small business to tow a trailer which keeps the haulage companies happy. If the authorities want to make the roads safer I would say make 7.5 tonne ownership easier for small businesses. A 3 tonne load on a small lorry is much safer than 3 tonne behind a 1950 throw back 4x4 marina ( sorry defender ). The tacho system on a 4x4 is so easy to get round if you were determined to break the law, it serves no purpose just more euro rules gone mad. Its easy to preach when someone else picks up the bill. Its a shame we feel the need to penalise small business in this country, all most people are trying to do is earn a living feed the kids and pay the bills. The people we should crack down on are the dole fiddlers and criminals but then they are not such and easy target are they.

 

Completly and utterly agree.:thumbup: If they made it easier i would have no hesitation in starting up with a 7.5t, they are a smart little vehicle and i think they are totally underated.

What they should do is do away with all excemptions and EVERY 4x4 that tows ANYTHING and ALL car that tow caravans should have to have tacho's fitted.

 

Vehicles towing huge caravans are more likely to travel long distance and go over their driving hours than any of us.

 

Make the rules to cover EVERYBODY and then there would be no ambiguity. Everybody would know where they stand, one rule applys to all

 

Likewise waste carriers license, no exemptions, not even for Mrs Smith and her grass cuttings, one rule for all, business or household

 

I agree, but with todays technology, why carnt they go further and fit a 'black box' type of thing like they do in aircraft.

definitly sure about 4x4 towing trailer (combined weight under 7.5 ton) does not need o lisence because is classed as a dual use viehicle ( on and off road).

i checked with my local vosa, so i know i am legal

 

It does not require an O licence because the vehicle is not over 3500kg. It has nothing to do with the dual use classification

I recently had to stump up £200 to VOSA for not keeping manual records in my GreenMech towtug Isuzu. That really cheered me up no end.

 

What I have a grump about is the sales people who flog 4x4 and commercial vehicles and supply these trucks without even asking if a tacho is needed or not. I've to change my car soon and not one sales person could tell me where they are fitted and how much in a Nissan, Isuzu, Ranger, Mazda, Land Rover and even the VW Amorak man suggested that as it wasn't a lorry I did not need a tacho! I would have thought they had a "duty of care" to inform and have enough knowledge about the range of machinery that they are peddling.

as i interpreted the vosa web site when i looked into it, im pretty sure it said that you are exempt for agriculture and forestry and the products of both agriculture and forestry if they are your products, so as firewood and forestry men, i think we are exempt tacho for deliveries for towing - as i would understand??

I have had problems with VOSA and the ministry before as I spend most of my driving time towing a trailer, here is a link to the relevant documents that covers what the exemptions are

 

Tachograph exemptions that are relevant are on page15

Operator licence get around's are in section page 11

The first part here is rather interesting Maximum unladen weight for 4x4 dual use vehicle

I'm sure there was a maximum distance for operators licences but i'm buggered if I can find it now, will probably find it amongst my paperwork because I printed all this out for when needed.

Hope that clears it up for some people.

I think you will find there is a clampdown on trailers in essex, a friend got pulled on the A12 pulling a trailer the other month and was fined for not having a tacho but was not put on a weighbridge to confirm he was over 3.5ton GTW, there was a whole load of trucks & trailer owners pulled in & fined along with him and they had to have the trailers recovered because they were not allowed to carry on thier journey with them, After speaking to VOSA about this it appears that essex police need some lessons on trailer law as they also reckoned that he was illegal because he was towing a trailer plated at 3500kg with a vehicle only rated to tow 2500kg trailer even though the trailer only had a mower that weighed about 250kg on it giving a total trailer weight of around 1000kg.

He was breaking the law as in this case the law is an ass.

 

Someone with a post 97 licence cannot tow an empty trailer rated to carry more than 750kg even if it weighs less than 750kg as they have the potential to go pick up a load taking them over there licenced permission (unless they have done the trailer test). The same applies with vehicles, it is the plated weights that count not what is actually on it, unless what is on it is over the plated weight
