Very odd! Sounds like someone else was involved and the two of them did not communicate with each other? Only a guess? Live and learn as ever but annoying for you and I think you have a right to make a formal complaint

Tough one really, we normally only consider we have the job when we get written confirmation (post / email ) as we have been burned before.

 

when someone rings to say we have the job we always ask them to confirm this via email.

 

So do I

Sounds like you had a binding contract. The starting position is that you are entitled to loss of profits and compensation for abortive costs. You are not entitled to the contract sum. But if you had programmed in the work (and hopefully confirmed the dates to the client) then you are generally entitled to the profit you would have made on the job plus the cost of labour for any employees who were unable to be put to useful purposes elsewhere by you.

 

The loss of profits is the only heading under which you are likely to recoup the money and time for quoting for the job and providing all the paperwork.

 

And don't rant about it to the client. But put it in writing to them that you have observed (quote dates etc.) that the work is being carried out be someone else and do they want to stand down? Until they say yes you have to keep your side of teh contract, give them firm dates and RA/MS. Until they confirm, if you behave as if you accept that you haven't got the job you won't be on a very strong footing to claim anything.

Some really good advice here. I think my position is, I will ask them if my services are still needed elsewhere on site, if not I will ask to recoup my losses and lost profit as suggested above. Cheers guys. This was a real blow for me as it's the first major works (more than a days work) I will have carried out for this organisation. I had put a lot of work in to preparing my team, setting up the safe systems of work in relation to the adjacent site and road, as well as revamping my RA's and MS's. Beyond that it was a job I was really looking forward to sinking my teeth in to.
