If he has a flue lining ie metal tubes running up the chimney from the burner to the exit then the smoke HAS to be coming back down yours from the top, has he altered the cap of the chimney at all?

You need to establish if it's an inversion layer pushing the smoke down from the top of the chimney because your house has a circulation that's drawing air down the chimney (as you don't have a fire yet). Or it may be cracks in the flue (bad thing). First mover would be a chimney balloon in the bottom of your flue. If that stops the smoke smell then try the same at the lop.

Does your chimney have a liner?

Our extractor in the kitchen used to suck next doors smoke down our chimney before our stove went in.

Does it get worse in damp conditions ? I find the smoke is reluctant to go upwards in certain climates and if the stack doesn't reach the ridge of the roof it tends to bring smoke back down the flue.

All good advice so far! One thing Id add though, get a carbon monoxide detector fitted fella, +- £20, easy instal, might just save your health/life!

Ditto the above. Carbon Monoxide is a stealthy lethal killer which claims many more victims than you ever hear or read about in the media.

as above install a CO alarm just in case also you could try blocking you chimney off as somtimes a chimney not being used can draw smoke down especially if your using an extractor when cooking
