That's a ridiculous statement. If I put myself forward as an expert and charge you money for the advice eg a property survey, and you suffer loss as a result of my faulty advice, then you maybe able to sue me successfully.

Free advice on a forum with no money changing hands and essentially anonymous as many don't post under their business name can hardly be held accountable. Get real!

No payment (financial or goods or services) for advice = no contractual obligation. :001_smile:

my Lawyer informs me the person who offered this advice would be liable in a court of Law.

They love saying things like that, gets people where they want them, but have you asked the lawyer if he will pay up if his advice is wrong???

Has anyone EVER got anything out of a lawyer

I visited a client this week who had tried to glean infomation on how he should proceed with tree work on a forum. The advice he was offered was poor incorrect and certainly did not reach guidelines set out under Bs3998. Had he undertaken the advice given my Lawyer informs me the person who offered this advice would be liable in a court of Law. So before any solutions, fungi idents or opinions are given in the public domain please make sure you are qualified and insured to be giving out this advice. This goes for offering climbing solutions rope and harness set ups and how you would make the work climb yourself. Sorry if this sounds hard but in worse case sinarios could you cope with the legal and psycological issues that would arrise from an accident or incident.

In my experience lawyers are at least as likely to spout nonsense as anyone else. You might like to consider whether any other advice he is giving you is equally accurate!

We'll have to finish any advice given with:-

Subject to status ask for written details. Indemnity may be required. This advice is only applicable in the uk and can be withdrawn at any time. For full terms and conditions please email advisor. This advice does not include Tesco clubcard points and cannot be used in conjunction with any other advise given.

To be fair I have had a couple of excellent contracts drawn up by a solicitor which were expensive but turned out to be a good investment.

On the other hand I have received threatening letters from other solicitors over the years which contained nothing but bluff and bluster and had absolutely no basis in fact or law so I'm not exactly a fan of the species!

What I'd like to know is whether the lawyer as part of his advice which can be relied on, cited case law of someone in the UK who was awarded significant damages for advice given for free on an on-line anonymous website where the advice was given in good faith?

If someone's said "it's an elm" but it turns out to be a Zelkova and gets awarded £100k against them then that would be pause for thought.
