Believe me, they can and continue to confiscate vehicles from the road when, during spot checks, said vehicles are found to be illegally using red diesel.

 

Plenty of info about it via Google.

 

I wouldn't underestimate VOSA. They're traffic wardens on wheels and absolute bast***s.

 

I certainly believe that you believe it but I don’t believe it and here is why.

 

 

VOSA’s remit is vehicle operations and safety thets where the O and S come from. It’s not unsafe to run on red.

 

 

HMCE is her majesties customs and excise, they are the ones responsible for gathering taxes owed to the crown, using rebated fuel illegally is defrauding the crown of revenue and her majesties tax inspectors take a keen interest in that.

 

In the same way that plod has field test kits and will call HMCE if they find you running illegal red, VOSA can call the revenue man as well. indeed most stop checks are joint exercises with plod HMCE VOSA and uncle tom cobly and all.

 

 

From what I have heard the first offence is usually a fine with the second offence leading to impounding (rather than confiscating) the vehicle pending payment of the assessed amount of defrauded tax, note the word FRAUD, most fraudsters go to prison.

 

Note also that the second offence gets the vehicle impounded, anyone can make a mistake, only a fool makes the same one TWICE.

 

If messing with a mans motor is the way to prevent habitual offenders then yes, all for it.

 

Do VOSA impund horses for not having the right paperwork as well?

Red diesel is taxed at 5%

 

Be in no doubt that VAT registered or not if you buy a litre of petrol at £1.40 then that is the cost you need to pass on to your customer - a litre of petrol most definitely does not "become 90 pence"

no gas oil for heating is vat at 5% red diesel is vat at 20% but reduced duty... so cheaper, more than £1.20 for every 1.48 paid on diesel is duty!

go vat reg. and claim it all back....

If you buy 2000L or less of red (gas oil) its classed as a domestic purchase, so charged at 5% VAT.

My apologies - did not mean to imply that the VAT rate applicable was 5% - as you point out not the case

That's where we'll have to agree to disagree, as I would reason that anything more severe than a fine is disproportionate to the offence at hand.

 

It's swings and roundabouts really. The government continually raises the already expensive price of fuel across the board, so when I hear of someone using red, I immediately sympathise. If fraud is committed against an already corrupt organisation, like certain areas of government and HMCE, then who am I to say that they're wrong for breaking the rules for their own benefit? After all, it doesn't hurt me or you, it just treads on the toes of government accountants.

 

Now if the price of fuel was fair, and someone was caught using red, I'd still maintain that vehicle impounding was disproportionate to the offence as a fine should be sufficient on the whole. I simply cannot see how the government has the power to confiscate another persons property for such a trivial offence that hasn't really, in the grand scheme of things, caused anyone harm or loss?

 

Anyway, that's my 2p's worth, which is about how much fuel is set to soon rise again.
