Law re. private tree work

Felling Licences are a completely different kettle of fish to TPOs. While you don't need a FC felling licence to fell a tree in a private garden, that doesn't mean you can just fell it.....

 

It’s a bit of a moot point since felling licences aren’t required for private gardens.

Rupe, your take on the property value thing with the Limes is pure gold. I'll be nicking that one off you mate!

 

 

Sadly the full story is that she sold her lovely big house (around £2M) to a property developer who converted it to 8 flats (at @ £.5M each) and the first thing he did was top all the trees!!!!

 

But individual flats is different from an exclusive private house with tree screening, each flat wants more light and as they are living on top of each other and share the garden, privacy is no longer there. It was a lovely house in the first place though!

If you get a felling licence you can fell, even if the trees are TPO'd.

 

Felling licence normally dictates replacement trees and as a TPO is actually a charge on the land the TPO would transfer to the new trees, I would imagine.

Not exactly Dave, a land charge would be registered on your deeds things like mortgage loans and the like. This is administered by the land registry.

 

A TPO is registered as a local land charge and that register is held with your Local Authority.

 

Felling licence kinda over rides TPO, the FC “consult” with the LA who can object if they don’t like what they are being “consulted”:laugh1:

 

The TPO can’t protect the new trees unless they are the subject of a tree replacement order (TRO) made under the TPO, if there is no application there can be no TRO.

 

Any re stocking could be made the subject of a TPO though
