I have rung him toay and told him to cut all the tree into discs and stack everything back onto my side. Upon which he offered to pay for the wood.

 

He offered £100 :scared1:

 

I told him that it was nowhere near enough, but rather than the wood be left to rot I'd accept £150 for the timber, plus I want the price of two standard trees to replace the ones he has felled.

 

I was thinking of replacing them with common Oak but then thought about putting in something different as it's on the wood edge with loads of light.

 

What do you thing of two Balck walnut (Juglans nigra :sleep1:) and does anyone know how much a container grown standard size Juglans costs? I've initailly told him about £80 each

I think you're letting this arse off very lightly. There's the issue of aggravated tresspass, criminal damage, possible breach of felling licence etc etc.

 

Send him a bill for what you'd charge a minted client to tidy it up, then a bill for planting 2 extra-heavy standard ornamentals. Walnuts are nice. I'd charge at least £300 to do it.

 

Don't let him off too easy, man!!:scared1:

I know what your saying Scott but I've got to live with him as a neighbour.

 

Everyone says I'm being too soft.

 

I'm going to make him buy minimum heavy standards but want to go for extra heavy and have them planted properly by someone qualified.

 

That wont be cheap because of the access, minimum telehandler to get across the river.

 

I'm just going to tell him that it's a condition of my felling license that the trees felled are replaced with heavy standard, if he wants to argue I can always get him to talk to my solicitor.

 

How do Juglans fair with the occaisional root wetting, they will be on a raised banking 4 ft above water level

It's getting a bit silly now. He's just been up and offered me £150 expecting it to cover the replacement trees as well. I've left the cheque with him and told him I want two extra heavy standard Juglans from Greenline trees Nottingham which will mean transport plus my costs for planting which will mean a bill of around £400 for replacing the trees.

 

He then offered me a 3m self seeded ash out of his back garden as a replacement which he will get his chap to dig up. Needless to say I'm sorting the replacements.

 

I can't get it through to him I'm trying to save him some hefty fines :mad1:

I think, given the circumstances, you may need to employ a mediator to sort this issue. As you wish to keep things civil between yourself and your neighbour. The natural reaction is to lose your temper with the man, and this would probably flair up if you dont feel you getting anywhere. He (or those in his employ) has trespassed and caused damage to your property. A fair settlement is to replace the trees, like for like. perhaps a solicitor would make him realise the severity of his actions, and politely steer him to your way of thinking. Good luck.
