You would think people in arb would know they have nothing to do with agricultural or forestry activity as it fall under horticultural activity #1

 

#1 Unless they do predominantly forestry or predominantly agricultural work under the same business.

 

If you didn’t do predominantly forestry/predominantly agricultural but only did arb the you would predominantly horticultural, if you claimed planning under agricultural or forestry you would be turned down rightly as you are not either but if you did it under horticultural activity you would be correct even though agricultural, horticultural & forestry have lots of similar/same planning exemptions.

I recently lost an application for planning approval in the countryside because LA defined arboriculture as mainly urban based work and it was not classified as the same as forestry, so the business could operate from a urban based yard, IE industrial estate and did not necessarily need to operate from rural location.

 

This only came to light after I submitted planning for a house on the site i had been using for about 6 years, with no complaints. When they refused me planning for the house they then wanted me to apply for planning for change of use from agriculture to industrial use for storing timber prier to logging, milling, and selling end products.

 

if it were me i would be appealing their decision , i would be asking if they had taken my turnover into considderation , also how many examples of a similar size tree surgery outfits opperating from industrial premises - i know firs hand that as a small firm it does not work and have only now finnished my 4 year lease . secondly do you not grow trees ? i would reccomend doing so prior to aplying for planning , mind you i am fortunate that my father is a planning consultant :thumbup: .

 

please dont think that im dismissing what you have said as im sure LA's work in different ways from area to area and thank you for sharing your experience with me :thumbup1:
